hi my names Shawn me and my parents moved to this apartment (in Maine) about 6 months ago ( i'm 17 ) and the rent was 800.00 for a 2 bedroom well two months later my brother moved in with us from Kentucky so are landlord raised the rent 100.00 for my brother. can he do that? then 3 days ago my landlord said he was going to raise the rent again. he said that oil was too high and he was going to add 200.00 more to the rent for oil and the oil is included in the lease ? so can he still raise it because of the oil? it says in the lease 800.00 a month (oil included) so i dont think he can raise and im not sure he can raise it for my brother either. so the question is can my landlord raise our rent 300.00 for my brother and oil? i dint think we should have to pay an extra 200.00 for something that was suppose to be included any help with be greatly appreciated if you could suggest some law sto that would be great thank you. |

I'd say no...thats why people sign leases, everybodys locked in for that time period...if your lease states every body living there, has to be on the lease, then you may have to eat that hundred.....as far as the oil...this aint his first winter in Maine, if he figured wrong, hes SOL for the remainder of the lease....but you better plan on movin, because he will try and recoop w/ a new lease............... |

Unless the lease provides for a rent increase for additional occupants or if the price of oil goes up, the landlord can NOT raise the rent during the term of the lease.
Read your lease. If it's silent on rent increases you are under NO obligation to agree to the rent increase. |

Hi,
Your lease would have to be on a month to month basis for your Landlord to do this. If your lease is a one year lease or longer than he can't raise the rent until the lease expires. Read the lease, and check if you are on a month to month....if you are he can raise the rent every month if he choses. There may be conditions within your lease that allows him to raise the rent, but the only way to know is to READ the lease. |

The landlord can usually charge extra for an additional occupant, which is what your brother is. IDK about the oil, i would think that if he did not give himself that right in the lease to raise the price due to oil costs, that he cannot do it. But it all depends on what the lease says. |

You'll find the answer in your lease. It should specify the number of tenants if he wants to charge extra for another one, and whether or not heat and hot water are included. If they are included, I believe it's his problem until the end of the lease. You can call the mayor's office or city hall and ask for the phone number of the department that handles landlord/tenant issues. They'll be able to advise on the laws where you live.
If you don't have a lease, the landlord can change the terms every month if he wants, and you can move out any month if you want. |

No rent increase unless in the fine print of your parents' lease is a clause covering extra resident and increases in heating oil. Besides heating oil has gone from 4.50 a gal. down to 2.70 a gal. Tell your parents to pay only what the lease stipulates. |

Maybe not for oil, but for your brother, he can..and a landlord can raise the rent per 6 months/year..it's all in your lease, read it to see if he put any of these matters in the contract. I charge my tenant $125 per 1 unreported new tenant, and only $25 per 1 reported new tenant. |

I'm not sure about Maine state law, but in CA, the landlord is allowed to charge extra for additional tenants (and can also set a number on how many people can live in the unit). i'm not sure about the willy nilly rent-raising though. there should be some sort of cap to rent (for instance, can only raise rent 2% in a year) and it also depends on if you're on a lease or month-to-month etc.
ask your state or county's rent stabilization board. |
