That depends.
If you've already been served legally with a 30 day notice of eviction via a court of law, and you haven't vacated yet, then yes, the landlord has given you "due process" and it is you that is to blame for your situation.
If he's just "told you" you have to leave and shut off the utilities? You have legal recourse TODAY to contact the authorities and bring your plight to their attention. There is a child at risk here; they don't take that stuff lightly now.
Or at least they never did before.....
You weren't real specific so that's the best I can do for you right now..... |

Depends on the laws of your state. In my state the land lord is required to provide utilities and maintenance until the court tells you to leave. He can't turn anything off until the forcible entry and retainer is awarded. |

Well why are you being evicted? Having a baby doesn't prevent you being evicted if you're NOT paying rent. You had a lease, agreed to pay, promised to pay, are legally obligated to pay, but apparently aren't paying rent. As a parent, your FIRST obligation is to put a roof over your baby's head, so paying rent should be TOP priority. Who pays the water bill?
However, LL is not permitted self-help like shutting off water. But the water can be shut off for nonpayment by the water department. |

You're not telling the whole story. Why are you being evicted? |

No he can't whether you have paid rent or not the landlord can't shut off water to your residence. |

Go get a loan and pay the rent things won't get any easier, the man has to pay his way in life too he may have to pay a mortgage on the house and with no money he will loose it.
Hope things go ok for you and you can manage to do the right thing by paying your rent you have a baby to look after so you need a roof over your head. |

Did you pay rent? |

Real Estate Guy

Yep. So you have a 8 month baby. Unless the landlord is the father, I don't' see a problem.
You didn't pay your rent and now it's coming back to haunt you.
Pay your bills on time and this stuff will not happen. |

Hmmm...You probably haven't paid him his rent money.
I wonder how you are on the internet, from the library?
If not, such money would be better spent on shelter. |

Sure why not.
You are no longer welcomed and why should he make things pleasant for you. the baby is just and excuse. |

What do you expect for him to just let you run up more bills for him that you won't pay? It's not his fault you have a kid and can't pay your bills! GET OUT, find a shelter to go live in, why did you have a kid if you can't support it? It's not right you're costing this poor man money, you'd be screaming if someone was doing this to you! It's YOUR problem, YOU deal with it! Get out and let this man rent to someone who will pay! |

I am sorry to hear about this. Where do you live? What state or country? the laws depend on where you live, so without giving us more info about your situation we can't tell you much more....other than did you pay your rent in time? |

Tenent laws vary from state to state, but most require a court order and formal eviction by the sherrif. If you have not received a formal legal notice of eviction, then the landlord is acting illegally.
Call a legal defense help line, get your own lawyer or call the police youself to report this activity. |

Have you been given a legal 30 day notice of eviction? Is the time frame up and you are now just living on someone else's dime so to speak? After 30 days it is YOUR responsibility you have an 8 month old in such conditions not the LL's. |

If you haven't paid the rent he can do as he pleases. |

Should have kept the water in your name. |

Hi,
You say you are being evicted. Are you current with your rent? My guess is no and that's why you are getting evicted. You can go to the store and buy bottled water, and heat it on the stove and take sponge baths and bath your baby that way. If I were you I'd pay the rent next time. Dead beats finish last, and it's most often by their own choice.
Did you think life was going to be a free ride? Sorry you are doing this to yourself.
Note* Thank you for the thumbs down.... I see I struck a nerve with the deadbeats. Mission accomplished. |

So the utilities are in landlord's name.
In most states, when there is a child involved, legality of eviction is different. Contact social services in your area for assistance.
Renter's rights vary from state to state; check 'renter's rights' where you live.
However, take care of your baby first. |

Call the water company. Some states are Nazi's about water. |

If you haven't been paying rent then I believe he can. It also depends on why he is evicting you i.e. to sell the house, because you don't pay rent? I assume you have had the proper notice. He shouldn't cut the water off before the end of your notice period though.
Have you got anywhere to stay? There are always hostels where women and children can go to but not sure where you can find out about them - citizens advice, social services |
