I have let my landlord know the furnace was not working said he would fix but has not instead he leaves for vacation and had been left with no heat since Nov 12,07 and since have been heating my home with my stove!!! putting big pots with water having that be my source of heat plus now I have mold everywhere wall's ,celling's , and even on my furniture that toches the wall. My landlord has returned from his vaction on Dec 28, 07 and I let him know I was going to break my lease well now its Jan 24,08 still have mold everwere and he just fixed the furnace yet I am still breaking lease. plan to move out now ,but theretns wih calling police if he sees me taking any of my belonging out {he lives next door} What should I do please help. |

Take photographs, jot down all of your conversations with him, dates, times, what was said, etc. He can call the police, sure, but the police can't do anything. He CAN take you to court and put this on your credit though, at which point the above information I advised you to obtain is going to help your case.
Every state has about the same laws in reference to landlord-tenant statutes. The contract/lease you signed means nothing if it is in direct contradiction of your state's landlord-tenant act. The landlord has an obligation to you to provide safe, well-maintained housing, just as you have an obligation to provide payment of rent and also well-maintained housing. If your housing is not suitable to live, which it isn't if the furnace is not working, for reasons that are not your obligations to repair then you are not obligated to pay rent. Any judge will side with you. Go on and move out! |

Breaking your lease is not illegal. He can call the police but they won't do anything. You're not a prisoner there. Depending on what your lease says, you'll probably have to pay extra to break the lease. |

You have every right to move out and take YOUR belongings. He can't stop you. Not sure what the other person was saying about giving 4 weeks notice. A lease is a contract. Breaking it could have civil penalties, not criminal, so the police will not get involved. Of course he can file a civil suit to collect the remainder of the rent per the terms of the lease, but that's another discussion. |

the cops cant do anything if you decide you want to move that's your choice, and going by the mold everywhere it sounds like a health issue so if anything your landlord is in the wrong and could get into trouble . If you have been paying your rent you shouldn't of had to put up with those kind of conditions. once you move you should report him to the rental tribunal. |

The police aren't going to do anything. Really. They don't have time to deal with these kind of stupid things. Your landlord can't make you stay there. He's not your parent/guardian. You have to give him a notice ahead of time that your moving out though.... |

When and if he calls the police they will more than likely become your escort. There is nothing he can do outside of the court room to keep you from leaving. He's has not complied with the tenant, landlord fair housing act. You may have recourse to take action against the landlord for past rent and property damage. |

You should call your county or your state's housing board on them. You should be able to find the info online as to what office to call.
Then report the Landlord!
Having no heat during the winter months should be more then enough grounds to break the lease and still get all your money back from the landlord.
Next time this happens either with this landlord or any other, start with holding rent checks. Put them into an account and every month until it get fixed but a copy of the deposit slip along with a note stating that you've put the monty into an account, redeemable once the heater is fixed. |
