Can landlords in Tennessee make you pay 6 months rent up front?
This is my conversation with my friend.. The question is can these "landlord" really make them pay 6 months up front. I've never heard this. He boyfriend is deployed so they have the money. But it sounds shady.

"their app wasn't very clear and it asked for my mom's income (she was co signing)....well then it says list any other sources of income so we did all that... well apparently we really should of combined her income PLUS the other sources of income (the app didn't state that) so they said we couldn't afford to rent a place for 650 !!!!!
cant afford that! we could BUY it lol so they said we could pay six months in advance... so we said well here we will give you our portfolio then tell me if we can afford it or not!
she said nope 6 months up front...after searching and talkign to others and talking to them we finally gave up and said send the lease.....we will sign the lease, my mom is writing the owner a letter (after the lease is signed) and we will give them the money but i think we are post dating the checks lol.... idk though Steve said some one told him its illegal..."

Well my friend really likes it. She said it is bigger than most places she looked at. They will only be living here for 6 months anyways. He is getting PCSed to another state.

yes it is out of the ordinary and shady maybe though they can request almost anything in good faith, And if you have the money enough to buy the place then you might consider buying a place that would work for you and for the future post dating checks when the other party isn't privy to it, it then becomes illegal and you should avoid that kind of behavior especially when it comes to contract law

They can ask whatever they want, you just say "no" and move along. I always ask first, last plus a security deposit which totals almost 4 months rent.

They don't care about your portfolio, they go by your income. It sounds like you poisoned the well with this landlord, find a different place.

I have never required a resident to pay 6 months up front in 25 years.
In some states post dated checks are illegal.
Can also walk them right to the bank.
Run away from this, do not walk.

No one can make you do anything...You don't have to take the place and if you are that unhappy you cannot take them to court once you sign the lease. You are aware of the terms so you can't use it against them.
They have booklets on renters and leases just call the Public Protection in your county and ask for the book it's free.

Are you sure these "landlords" own the property? This is a common scam, they rent a place then sign worthless leases with as many "marks" as possible, then the "landlord", after cashing the checks, disappears. Be careful!

i wouldn't rent it, isn't there a better place? 6 months in advance isn't normal.

If you like the place and have the cash then go ahead. Just make sure you get an itemized receipt breaking down what you paid them. And no, they are not looking for post-dated checks. They are looking for 6 months upfront- that means one lump sum, payable immediately, not post-dated checks.

Know your rights as a tenant by looking on the Tenant RIghts law in your state. Call whatever government agencies existing in your area that may advise if what the landlord was asking for is legal or not. If it turns out to be illegal, report to the authority and they will take over from there.
