Can my Girlfriend be held resposible for rent if she was not on the lease?
I broke my lease in March of this year in Arizona. My girlfriend lived with me for a little over a month. My landlord named both of us on the court documents. She was never on the lease, only I was. Can she be held responsible for any of this? There is nothing in the lease about it.

Your girlfriend has no obligation on the lease as long as there wasn't an implied agreement between you and the landlord that she would also be responsible for the lease.

The landlord can name anyone on the lease and she will have to answer the complaint but I doubt the courts will find her jointly or severally liable for the lease.

If she did not sign the lease, and she is not named on the lease ( but if she didn't sign she didn't agree ), then they CANNOT do anything to her or get any money from her.

No, she can not be responsible...The landlord is trying to collect at all cost. The written lease agreement is between you and the landlord only.

I'm not a lawyer, but I'm pretty sure she can't be held responsible for the rent unless he can prove she was living there full time. Which is hard to do unless the utilities were in her name.

He's just suing everyone in sight. But she must appear in court. You should negotiatewith your landlord, because unless you have piles of evidence to support yourself you are gonna get nailed to the wall.

Unless she specifically caused damage to the property in general, probably not.

Your girlfriend was not on the lease.

No...she cannot.

The landlord is grasping for straws b/c he thinks you can't pay.

If she is not on the lease as MORE than just an occupant, then he cannot sue her...only you.

PS: "Implied" agreements are verbal agreements and are NOT legally bindig in real estate. For a valid, real estate contract (even a rental) you have to have a "meeting of the minds"...she didn't "meet" anyone's mind b/c she never signed anything.

She does need to show up...and I would probably file a countersuit for her time b/c he knew she wasn't on the lease.

Only if damages occurred to the property that resulted from her being there. However if she was there longer than what your lease/rental contract stipulated for a visitor then she may also be accountable depending on the state statutes regarding cohabitation.

No I don't think so. One of my friend had the same problem, but none of the persons except contract signed tanents had to pay anything.
