Im moving out of my rented flat the end of October. I gave him my 30days notice today which he was happy about. He did said however that he will have to start looking for new tenant's, which is understandable. But what made me worried is that he intends to show them while im still living here. I don't mind if he phones me to let me know so I am at the property, but he also intends to let himself in and show them around while im at work. Is this allowed? Surely he cant show them around while im not there even if he does ring me. I have paid up to the 4th of November and im leaving 24th october so I don't see why he cant wait till then.
Any info would be appreciated Additional Details So while im at work he can ring to say he is going to let himself in and show people around. What about my rights? what if i come home to find things have gone missing etc |

I'm from the UK, so if you are I'm pretty certain he's got to give you notice but its a complete yes ; usually backed by your contract you originally signed.
It's his property, and in his interest to show potential tenants around the property, so if a potential is only able to view the property on a certain day/time of day, and you happen not to be in, thats not the landlord's problem, but he still has to give you notice.
You could agree to show them around yourself, or make sure an estate agent does it. Or, get a family member or friend in if you're out to look after your stuff if thats the problem.
However, if you are really worried about it, and are pretty sure you've never been told/read this. Find your contract you originally found, and then look online or in the Citizens Advise Buearo (sp?) to see what they can advise. |

edit - he cant ring you on the day and say he is going to do it without your permission think he has to give you 48 hours notice, and if things go missing phone the police
edit - As I have said he HAS to give you notice, he cant just turn up and enter the property (unless its an emergency)

He can enter the property to re-market as long as he gives you 24hr notice. I understand your concerns about security and privacy but this is a common occurrence. Every estate agent in the country begins marketing before the end of the present tenancy to avoid a void period (when the flat is vacant and not bringing in any income). I would recommend that you discuss this with the landlord ask that he gives you 24hr notice before visiting so that you have time to store away from view personal or high value belongings.
You must keep in mind that for the landlord, if he waits for you to leave the property he will be losing your weekly rent every week while he looks for tenants, plus the market slows in the close of the year as people's attention turns to Christmas and other expenses. There will be fewer people looking for a property so the marketing time will be longer.
Talk it over and I'm sure a reasonable solution can be reached, but it terms of the question, you he is entitled to access his property for re marketing once you have notified him of your plans to leave. |

READ YOUR LEASE. But yes, he can show the apartment without you there. He has to give you notice, but he can show. You do not own the building you are just renting, so it does not give you the right to refuse entry with reasonable notice. |

If you read your lease before signing I am sure you will have seen the clause relating to this. The landlord has every right to show a house or flat in the notice period to prospective tenants. He can give you individual notice of each visit if you want that but it is usual to have it written into the lease that during a notice period you accept that their will be visits to your home. You may even find a clause saying the place should be clean and tidy etc for such visits. You are welcome to be there of course but obviously you cant always be if you are working.
I would not be pleased to get only 30 days notice. I ask for 2 months on all my leases. I only do the visits in the last 21days though. It is necessary to do this to have time to take up references etc and have a smooth changeover of tenants.
The chances of anything being 'stolen' are minimal your landlord is a professional person. He has trusted you with his property for however long it wont harm you to give him the same trust.

Your landlord has to give 48hrs notice of a viewing. Even if he does this, you can refuse to let him in.
Despite what people say on here, you are entitled to refuse access totally.
The Landlord has no absolute right to intrude into your property His only rights to enter during tenancy are:
a. when Tenant agrees
b. under s.11(6) of the Landlord and Tenant Act 1985 24hrs. written notice asking for T for daytime access so L can inspect installations which he is responsible for repairing. You need to put that in writing to the landlord, and when you draw his attention to the Tenant Act, he should back down. You can use this as a bargaining tool, you will agree to viewings, with 48hrs notice, or time to suit you, if he is not happy with that, then just refuse.
If he continues to be difficult, then you are leaving on 24 October, but have paid till 4 November, therefore you have a right to hold the keys till then, and refuse entry till then. If he rents the property and tenant moves in before 4 Nov, he will have to return you the days that you have paid.
I would think
Certainly Landlord cannot just to show property to prospective purchasers or tenants. This is not only trespass (civil wrong) but also harassment (criminal offence). |
