NOPE, if it's not in lease. READ lease very carefully, then call and find out what this is about. Some management charge a fee for two checks, for late payment, whatever, but fees must be disclosed IN ADVANCE, in writing. |

Unless your lease provides for it, no they can not. PERIOD.
However if your lease has run its initial term and is now month-to-month then they can charge the fee once they've given you 30 days notice. |

I Buy And Sell Houses

They can only charge what was specified in the lease and any lease addendums that you agreed to. So, for instance, if they're charging a $5 service fee because you pay in cash, or by check, or because they provide you a paper invoice, or whatever--if it's specified in the lease, you owe it. If the charge is not mentioned anywhere in the lease, they shouldn't be charging that. |

Nope. If it's not in the lease, they can't charge it. But, if you are taking advantage of an amenity that is not in the lease, like dropping off your rent check in the office instead of mailing it to a P.O. Box, then the charge would be permitted for that service. But they would have to give you the option of paying only the amounts and charges specified in the lease.
So, the answer depends on what you are consuming at the property and if everything you use or do is covered in the lease as well.
