There is no law against it, but if your aunt sells you her house for peanuts, you and she both need to be aware of any tax implications. If it is her main residence, does she intend to still live there? If so, to avoid the value of the house being taken back into her estate for inheritance tax purposes, she would have to pay you an economic rent (that's a market value rent). You would be taxed on that. Even if she is moving elsewhere, she would have to live for seven years to avoid IHT. Also if you were to get divorced or fall out with her, she could lose her home.
If it is not her main residence, the property transfer would be regarded on the market value of the property,whatever the actual purchase price, and your aunt would be liable to Capital Gains Tax.
What I would suggest is to do what I did, consult a financial adviser (a proper one, not one of these fly-by-nights who do a couple of days' training, and then set up in business), and consider a trust being set up. It costs, but is worth it. |

If pressed, the government/taxman would probably consider the difference between the price and the value as a 'gift' and treat it accordingly.
If you are really going to go through with this it would probably worth getting professional advise.
I think gambling is outside all the tax rules -- so if you 'won' the house you may be better off... You never know... |

She can't sell her house to you for peanuts because the Inland Revenue would be after her. Land Registry checks the sales of properties and he may think that she is trying to avoid paying tax. She can only gift you a certain amount every year...or make a one off gift as a wedding present for I think that it is £3000...

unless the law has changed you can legally sell anything for the minimum ammount reconised legal tender which is £1.00 stirling. But check with a solicitor first because it would have to be legally binding. best of luck. |

You can sell it for whatever you want. Not many people would be interested at a price higher than the surveyed value but lower is fine. |

if you intend getting a mortgage, the lender will ask a few questions if it is bought for less than the market value. they will be worried in case there is something wrong with the property that they need to know about. It might have had subsidence or something in the past that you have agreed to ignore for a cheap sale, and they will be concerned. if not mortgaged, she can give it to you for nothing if she wants! |

Your Aunt is going into a home and they will eat the property value in paying for her accommodation?
No, nor can she transfer the property to your name, it has to be marketable value, (bottom end).
Only way around it is to look after her yourself. Sorry a friend just had this problem and she and her sister actually bought the house in their mothers name. |
