filosfer | Can my flatmate charge me any rent as high as he wishes to? |
I live in a suburb in sydney. I live in a 2 bedroom flat and share a room with another guy. The guy who owns the lease for the apartment lives in the other room. He charges us two guys rent that is almost equivalent to the rent of the total house. I know this is not ethical, but is there anyway I can do something about this? Is he allowed to charge me any rent he wishes? He has never disclosed the actual rent to me and never bothered to put my name in the lease. I asked him several times to do so and I am fed up with this. Any suggestions?
I am moving out anyway, but I feel I should get some justice here. Additional Details I wish to add that it is illegal to sublet without a legal agreement. I am a student and I really didn't have much of a choice. I understand the capitalistic theory, but isn't this clearly 'taking advantage of the situation'.
By the way, my parents own 5 houses in my native country and they don't charge insane amounts in the name of rent. Legally this may not be an issue, but come on! whatever happened to simple human ethics? |

If you are not on the lease, then you are more or less subletting from your flatmate. And yes, he can make you pay any amount he chooses to. You more or less agreed to pay that amount by moving in and paying him the rent.
If you wish to be put on the lease, you and your flatmate will need to agree to do so, and then go to the landlord to have it done. Your flatmate can't do it alone because he would have to have your approval, but you can't do it alone since he owns the lease right now.
I think it's rude of your flatmate to charge so much, but you basically agreed to pay it so you're kind of stuck now. = |

You are confused -- ethically there is absolutely nothing wrong with subdividing an asset controlled by one person according to that one person's wishes to other people. It is (part of) the basis of the capitalist system. If the building and/or community has no laws or prohibitions against subletting an unit, then it isn't likely a legal issue.
Did you two sign a lease?
If not, find a better place at a cheaper rate and move the hell out.
If so, do the same thing after the lease ends.
The part you are mis-understanding is that "actual rent" is a fiction. If you are not a legal party to his lease, it is his cost. Your rent is what you accept (don't forget that little fact) as your rent.
The practice is very common both with owners & sub let's around the world: The party with control (money, credit, whatever) subsidizes (lowers) his cost buy charging more to those with less control (money, credit, whatever).
Ask yourself this question: do you think the actual property owner charges the guy more or less in rent than the owner pays in mortgage costs? More, of course. Probably a lot more. |
