Tenants have rights. I was given 90 days notice, but stayed 6 months. She can ask you to leave and give you the papers but you don't have to leave until she has taken out a court order to have you evicted. If you are in the UK, in order to be rehouse by the council you must stay in the property until you get evicted otherwise its classed and making yourself homeless and they wont help you. When you get the notice to leave take it to the council housing department and they will help you. They have a department that deals with private tenant's rights. |

When you took out the lease it would have had a fixed period, e.g. 6 months. Once you're past that it is usual for the tenants to give 1 month's notice and the landlord to give 2.
Like the first respondent said, check your lease. Also ring the Citizens' Advice Bureau. |

Your notice period is agreed in your tennancy agreement - this is the document you need to refer to and will hold the answers!
The fact it is being put on the market is immaterial.
I am not sure if you are being told that you cannot leave withou two months notice, or that you have two months notice and then have to leave - either way, the tennancy agreement will hold the answers!
Most agreements normally default to a month or twos notice after a set amount of time (six months often). So what you are saying sounds quite normal.
If she sells the house whilst you are in it, it should be sold subject to your existing agreement.
Although unless you particularly like the property (and hope it will be sold to another landlord) I think the writing is on the wall and it might be time to start looking for somewhere else to live. |

Read the terms of your contract for this cos they differ. |

If you have a lease.....usually 60 days notice prior to the end of the lease is required....
If you are month to month....then 30 days is the rule.... |

If you are in the UK and have an assured shorthold tenancy she has to give you 2 months notice in writing. This is Law and defined in the Housing Act. So yes, she is right. |

it's all in your rental contract. if there was no contract or if the contract does not state any terms for this, check out http://www.hud.gov/local/ca/renting/tenantrights.cfm |

It depends where you live.
Are you in NJ? |

You should have signed a tenancy agreement when you first moved into the property which will state notice period required, if you didn't sign anything then you can put your notice in writing stating that you have no tenancy agreement and telling her that out of courteous you are giving her one months notice (only when you have found another property). |

Your lease should say how much notice you need to give. If the lease says 30 days, then no, she can't make you give 60 until the lease expires or is amended and signed by all parties. |

It depends on your contract if you are in a 6 month contract, then she has to run through the contract. But If she is putting the house you live in on the market and you are not tied, then she could ask you to move out at anytime....so it works both ways, you will need to find somewhere else so you could also leave at anytime obviously if you have started a new month the rent will be owed for that month. |

If your rental agreement says you only have to give her 30 days then thats all you have to give. |

She probably is right. What does your lease say? Even if the lease has expired...you still need to follow it's terms of notice. |

She is in the right depending upon what the lease states. Most landloards only state 30 days, so feel lucky if she is giving you 60 days instead. |

Afraid so, if its in the agreement for tenancy. |
|

Lori S
|
The answer is in you written agreement that you have with her. If you are on a month to month agreement, usually 30 days is legal. If a year lease, you usually have to complete the term of the lease to move without incurring any penalty for early termination. |

If you are on a standard Assured Short hold Tenancy then you have two months from the delivery of an eviction notice. However if you have been renting for four months or less you will have six months from the start of the lease.
Your landlord should give you a properly created written eviction notice. Just telling you to go is not enough.
If you have any queries then the Shelter Helpline is very helpful on 0808 800 4444. |

What does your rental agreement say - ???
If it says one month then one month it is - she can't change it verbally like that without giving you notice of any changes |
