Can my landlord bring me to court even if I haven't been issued any notices for back rent?
Ok, let me explain. Last month the bank, (honestly, it was the bank, they took back the fees), basically messed up my account. I had rent to pay and an electric bill, put in a check to cover both, and they said because it was after 11 it didn't cover it so they put the electric check back in first then my rent, with return check fees. Anyways, the electric worked out fine. We spoke to them, they said they'd try again, and we didn't get any fees. My question is my rent check returned and they never tried it again, and I haven't gotten any notice stating we were late, had a return check fee, nothing. Can they still evict me without any notice? I don't even know if they've noticed yet, and I don't want to send in another check in case they do decide to put the other one back in.

My question is, can they evict me or take me to court without trying to receive payment?

They may not know yet.

They have to issue a 3 day notice to "pay or quit" before they can start the eviction process.

It would be nice of you to give them a call and explain what happened and just ask them to re-deposit the check. You should also refund them the bounced check fee, which is 30-40 bucks.

what's wrong with you that you aren't on the phone to them to explain what happened and get it straight with them? Is it worth the risk of being evicted to wait? It's up to YOU to make sure the rent is paid, not for them to notify you!

they would normally send u a 3 day pay or quit notice, meaning pay up or quit the premisise, it would be a warning to let u know they will proceed with the eviction. contact management, m ake arrangement for payment and clear it up before they start the eviction, even if they start it u will be responsible for all legal fees and u dont need to pay extra money if u dont have to

THEY don't evict. Their first step is a Pay or Quit Notice.

But why are you even asking? YOU know it bounced even if they haven't figured it out yet. Get ahead of the problem. Call them and be upfront about the mix-up and settle-up..

Usually rent checks will not get redeposited and the check casher is the last to know that the check was returned. You need to contact your landlord and give them a new check ASAP. You are basically living rent free right now, so you will be considered as not paying at all

So you didn't pay your rent and want to know if they can evict you? Hellooo!!! Yes, of course. They do have to give you a 3 day notice to pay rent or quit before they take you to court, but be assured that will happen sooner or later.

Just call the manager and tell them what happened. Ask them if they want to send back the original check or should you give them a new one. Pay the returned check fee and the late fee too. Just suck it up, you don't want to mess up your credit over somethign stupid.

Don't panic. Give them a call, explain the situation, mention the electric as well and say the same thing happened and they were fine about it, ask if they have or are going to resubmit the check and then ask if they would prefer a cash payment this month and that it won't happen again. The quicker you inform them the better it looks for you.

If you have not been known to be late in the past it should not affect your tenancy.

Anybody with the filing fee can take you to court. That doesn't mean they will or they'll win if they do.

Seriously, if there's no other problem, and you pay them, it's not likely they'll try to toss you out. If you've been a good tenant in the past, they'll understand there was some kind of problem, and it's a lot of trouble and expense to take someone to court or try to evict them for no good reason. It's throwing away money basically.

Not only can they evict you...they can also have criminal charges brought against you. While it was the banks screw up.....you should of contacted the management to let them know about the problem and rectified immediately.
