Your contractual obligation is towards your Landlord, not the mortgage company. What he does with the rent money isn't your concern, just make sure you have receipts for every penny that you give him. |

Technically, the lease between you and your landlord has nothing to do with his mortgage. Whether or not he pays his loan like he's supposed to, you're supposed to make your rent payments.
Having said that, if the house goes to foreclosure, you will likely be evicted from the property. I don't know what state you live in, so I don't know how long the foreclosure or eviction processes take.
I agree that it's not fair that you should have to live with the possible threat of eviction hanging over your head even though you pay the rent on time, but that's the way it is.

Yes, it is true. You are still legally obligated to pay him the rent up until the day that the title is transferred from his name.
You cannot live there for free.
Your lease is between you and the landlord. You pay rent for the right to live there.
If you do not pay rent, the landlord can evict you and sue you.
The landlords failure to pay his mortgage or the landlord having a lien against the property is none of your business and NOT a reason to stop paying rent.

As long as he owns the house and you live in it, you owe the rent. His mortgage and lien problems are not grounds for withholding rent. |

Hi,
You have a contract with your Landlord....not the bank. Yes, you do have to pay your rent. What the Landlord does with your money is His/Her business and has nothing to do with you. I strongly suggest you pay your rent, and do it on time. Your Landlord may have missed his payments due to tenants not paying their rent at all or on time. Besides two wrongs do not make a right. Do the moral and ethical thing and pay your contracted rent. Who knows who just might help this Landlord avoid foreclosure. |
