I have lived at my house for 8 months. I love it. When I moved in, the house needed a little fixing up and there were a couple things the landlord said he'd get out. Well, he promised he'd get the house fixed up and never did, and he also never came to get his stuff. I ended up putting it out on the garage, and left it. I didn't use the garage so I did not care. Now, all of a sudden, when I tried to pay this month's rent, he would not accept it. Instead, he said that he had sold the house he lived in and needed me to move out by the weekend. He has a security deposit of mine as well.
My signed agreement says he has to give me 30 days. He gave me less than 24 hours notice. I have two young children.
What can I do??
I am currently looking for a new place, but I can't find one in less than 24 hours. |

Your landlord is an idiot....he must give you proper 30 days notice, in writing, to vacate. As long as you did not violate any terms of the lease...this is the law. |

You have a right to stay for 30 days after a proper notice. Tell him that and agree on a date.

Nobody can kick you out on a days notice. If you didn't have a long term contract, he can kick you out. He can not, however, kick you out in a moment's notice. He is being an a**hole anyway if you think about it. People usually don't decide to sell their house, find a buyer, and finalize the closing all in a week. He probably knew ahead of time that he was selling his house. There is, as of now, no law against being an a**hole though. |

He has to legally evict you throgh the courts...if he does anything stupid like changes your locks or moves your furniture you can sue the bejessus out of him. |

He can't ask you to leave in 24 hours. You must be given 30 days written notice. Good for you he won't take any more rent, but don't plan on getting your security deposit back. Sounds like a jerk to me.

If you have a lease you can stay til the end of your lease. Document the attempts to give him rent payments. Tell him you need his request to move in writing. And when he takes you to court for eviction present your evidence. Unless you are a month to month tenant, you can finish the remaining 4 months of your lease. Otherwise, he can give you a 30 day notice and must return your security deposit if the property is in satisfactory condition. You will, of course, prove the last part with pictures. |

No he cannot give you only 24 hours to vacate that's not fair at all he must and legally give you 30 days to vacate. You need to tell him that by the lease which is legal and binding he must give you no less than 30 days to vacate and you're not leaving until then. Even if he filed eviction it would take longer than 30 days so stick to your guns, NO judge is going to allow him to kick out a single mother with 2 children out on the street.
You have every right to stay, even if he calls the police you have a lease and you have every right to be there. So take the 30 days. |

If you have a WRITTEN agreement he cannot throw you out. Evictions have to go through the courts. Don't panic,on Monday call all of those state and federal housing people and if necessary call the police. |
