Can my landlord enter my property anytime he wants?
I live in a 2 bedroom house and the landlord comes over whenever he wants and goes in our backyard and picks the fruit fruit. He looks through my trash and my neighbors said tries to see in the windows. I don't know if he ever comes inside. But, it creeps me out that I can get out of the shower and there is man in my backyard!

Isn't the fruit MINE? I pay the rent, water and prune the trees. He is picking my oranges and grapefruit now. It will break my heart to loose all of the cherries later. I care for the trees, pay for their fertalizer and water. I want the fruit too.

I did not think my trash was public while it was in my backyard. I realize that anyone can look as soon as I put it in the public street.

It's actually his backyard, not yours. And they are his fruit trees as well. And once you put out the trash, anyone can go through it.

But the line is drawn at window peeking! And he cannot enter your apartment without your permission except in an emergency. He does sound creepy. You might want to consider moving.

it's his backyard and he can go there whenever he wants to. but if it's creeping you out, catch him in your backyard one of these days and ask him, "what can i do for you?" and if he lays down some lame excuse you know isn't the truth, then tell him nicely that if there's anything he needs, he can go in, but if he doesn't have any important things to say or do, he shouldn't come in the backyard because it's creeping you out. you'll never get anywhere unless you explain your side.

instead of being mad, pity him
he is doing nothing illegal by going into his own backyard....
if the trash is outside he is not breaking any laws by going into it

GET A CURTAIN for your shower and you wont even know if he or anyone else is back there.

It is okay for him to use the fruit tree, its his. But going through trash and looking in windows is illegal. Also he can not enter your house with out giving you notice. Usually 24-48 hour notice. Check your lease. Then talk to him. He sounds creepy I would move out.

legally, i believe the landlord can enter the home. you will have to look at your lease. going through your trash, although not illegal, is creepy. i would think that he would have a right to the fruit, just as you would. i would write a letter to him, because in your face confrontations may be uncomfortable. if, at that point, he still continues to "harass" you and creep you out, then i would notify the police, or file a tro, or move out.

So long as there is no provision in the lease that states you are entitled to the fruit, he is within his rights. The trees are on his land after all. Stop taking care of them unless you agreed to keeping them fed and watered in the lease.

As far as his creepy behavior, that's just ...CREEPY. He may only enter your apartment unannounced in an emergency. Otherwise, he is required to give you 24hrs notice.

The trash is public once you toss it in the can, but again - CUH-REEPY!!

I would solve this by moving out the day your lease is up. Send him no less than 90 days notice to ensure your bases are covered and run like hell. This guy has weirdo written all over him.

If you care for the trees, ask the landlord to allow you to have some of the fruit. It is his property and he probably thinks you don't want it, so he is taking it. Or you could tell him that you will pick some fruit for him and leave it somewhere he can get it. Tell him it is unsettling to have someone appear in the backyard, and you would rather he call ahead. Just have a conversation with him about it.

My neighbor looks through my trash. He doesn't rip open the garbage bags and pick through it, but he opens the lid to see if there are things he wants, he took a broken rake handle out of there a couple months ago. It doesn't bother me. If your landlord is picking through your bagged garbage, that is strange.

Looking through the windows is another thing landlords do, he wants to see what the house looks like. Again, I would suggest you talk to him about it. Tell him it makes you uncomfortable, and if he wants to come in to inspect the property, you'd be happy to set up a time for him to do so. In the meantime, please no window peeking, as a single woman it disturbs you and you would rather him not do it. If that doesn't stop him, call the cops next time he does it and say you saw someone but didn't recognize it was him.

I'd move if this course of action doesn't stop him.

no he cant. unless of an emergency. and if he does enter your house when youare not home he must let you know why.as far as the fruit fruit not sure what that is. is it a fruit tree like apple or some other kind of fruit? if it is his property then the fruit tree is also.he can take whatever fruit he wants.as far as going through your trash dont see why anyone would want to do that. looking in your windows is not acceptable. i would try to catch him looking in your window then you can call the police. there should be no reason for him to do that.

Actually in some states, he is trespassing. You rent this property and for now, it is YOUR home. He has the right to inspect it on occasion... but he is to ask permission. This should be in your lease. It is rude of him to take liberties of that nature. Read over your lease and find that clause. Then write him a letter and ask him to please call in advance if he is going to come to the property. It makes you uncomfortable to find someone on the premises. Say it is for safety reasons. Then always keep copies of any correspondences. Incase he does turn out of be a weirdo, or you have any problems with him down the rode.

i would ask that he stop doing this or to come at another time...thats kinda creepy though. i dont think they can come ANY time just be nice and ask that he come by when youre not home. give him a time.
