Can my landlord evict me for breaking a window?
because he's calling my job threatening to evict me. not only that but he tells my co workers, or whomever answers the phone that he's going to evict me. is that ok? i feel very harassed.

Yes, he can evict you for breaking a window. That's considered property damage and if you signed a lease, I'm sure it's in there. Would I evict someone for breaking a window? Depends on how it was done - if it was an accident or a malfunction of the window, no. If it was a drunken party and someone threw a bottle or furniture through the window, and it wasn't the first time there had been issues, I probably would.

However, he is really violating your privacy by telling your co-workers you will be evicted. The only way you're going to be able to stop that is either have a lawyer send him a cease and desist letter, or sue him for defamation and slander. That's going to be really hard to prove.

You need to talk to him - it sounds like you are avoiding him. It's not a good idea to ignore his calls, because it's just making him angrier.

If you dont pay for the repair then he could kick you out for damaging the property.

Expert Realtor
Ok...you destroyed his property, probably did not offer to pay for it...and you are wondering why he wants to evict you?

What he is doing is not harassment, it's called bill collection and he wants you out.

He can get an eviction if he can demonstrate that you or your guests are destroying property.

You have to work really, really hard to break a window in a house/apartment.

He has no legal obligation to your privacy. If you want him to stop calling, either pay for the damages or honor his request to move.

Landlord
Of course, you are vandalizing his property. I would be pretty upset myself. You need to get the window fixed this weekend.

No, but he can charge you for the repair, so you might as well arrange to get it fixed.

Calling you at work sounds a little crazy, tell him what you are planning to do and tell him to stop calling, or you will call the police, he is harassing you.

Yes...he can tell whom ever he wants...as long as it's the truth.

You need to fix the window you broke.

Pay for the window. apologize for breaking the window, and then ask him if everything is back on the up and up now

Do you have a lease or do you rent month to month? If you have a lease, while your landlord may make you pay for the cost of the window, he or she may not evict you for breaking a window. That would not be considered breaking the lease (at least any lease that I've ever read). If your renting month to month, you landlord can evict you for anything really, just as you can move out anytime to you want. That's the risk of not having a lease.

Chris Pascale
That's what your deposit is for.

Read your lease to see what he can evict you for, and if he continues then finda place and tell im to sign you out of the place if he wants you out so badly.

Confused
If you broke the window, you must fix it. Have you spoken to him about this? Landlord can do anything he wants but he really shouldn't be calling your job and telling your co-workers anything about your personal matters. Talk to him about the window and come up with resolution. Also, be clear that calling your job and threatening you over the phone is illegal. Even more, you can threaten him back by saying you will sue him if he does not stop calling your job and even more, telling your co-workers about your personal business.

What hi is doing is called invasion of privacy. He cannot discuss your personal matters with whoever answers the phone. If it was me I would tell him I am going to fix the window, but will you please quit discussing our personal matter with strangers.

ask him if things will be okay if you get it repaired. as long as you are keepin up with the rent money, you should be fine.

You should have the window repaired sooner than ASAP! By leaving the broken window in place you are reducing the value of the building and making the neighborhood look trashy.
How long has the window been broken?
Why didn't you have it fixed immediately?

Any time period of more than three days would make me angry too. Stop delaying the repair. I would say the landlord is tired of waiting for you to repair the window and would just as soon have you out in hopes of renting to a more responsible tenant.
