Can my landlord evict me from an apartment building in foreclosure if I refuse to pay the rent in Minnesota?

Yes, the foreclosure and your rent are not related to each other.

There is nothing in your lease because it has nothing at all to do with you.

You can be evicted just like any other dead beat who is not paying their rent.

Well then YES he can because YOU are breaking your promises, breaching lease terms. YOU are obligated to pay him rent, even if the building is in foreclosure, and he may cure the foreclosure at any time until it is final. Once foreclosure is complete, your lease will be voided. So by your own posting, YOU are the one violating lease terms and you can certainly be evicted and have that on your record.

As long as the landlord is still the legal owner of the home, you are obligated to pay rent. If you fail to pay, he/she has every right to proceed with an eviction.

Why do you think it's ok not to pay?

Yes. A foreclosure does not automatically void the lease contract. Wait for them to come to you and tell you whether or not they are retaining the lease. They may offer you a buyout which puts you in the position of power. Whereas if you stop paying rent then they will have all the power.

Why yes two completely different issues. Whether he owes money or not is none of your concern the fact that you owe is of your concern. OMG if all the people paid their rent he might not be foreclosed on. Yes your contract is separate and is with him not his mortgage company, so either pay, or you will be out in the snow what does he have to lose? Live up to your obligations and don't worry about others.

From my experience, a landlord can almost always evict you. If it's in foreclosure, it seems like you're going to get the boot at one point or another anyway. You might want to look around and see what's out there.

Yes it doesn't matter if the landlord is in foreclosure or not you don't have the right to live for free in someone else's place. Either pay rent or be prepared to get evicted.
