I am under a 1 year lease that expires in April 2008. I have to notify my landlord if I am going to buy the lease to purchase I am renting from him. I am not going to buy it. I will be cooperating with showings while I am living here. If someone wants to buy the house before my lease is up, can my landlord evict me so they can move in before my lease ends in April 2008. No he/she can't do that if you signed a lease. I was in the exact same situation 2 years ago. I had about 6 more months to go on my lease and I got a letter from the landlord stating the place was in the process of being sold. The only thing that changed was that I was to send my rent check to a different person. The new owner does NOT have to rent the unit to you after the lease expires but is obligated to honor the lease. You're good until April 08 but I would start looking for a place in Feb or early March. |

NO! The lease runs with the property. Just like an easement, mortgage, lien, or covenant, a lease does not terminate and become unenforceable just because the property changes owners. The new owners will be purchasing the property subject to your existing lease.
However, this actually creates a good situation for you. If the landlord is intent on closing escrow before your lease expires, tell the landlord you will happily cancel the lease provided he pay you a relocation fee of, say $1000. (Make up any number you think is reasonable.) |

If you have a lease, then he would have to wait until the lease is up. If you have no legal document stating anything then he can evict you. |

In all the answers listed here you find two schools of thought and both can be right.
The lease does follow the property and if it is sold then the lease continues until the end of the term. However, you need to check your lease. Many leases have a cancellation on sale clause. this clause basically states that if the property is sold the lease ends. I have this clause in all my leases. This protects the landlord so that he/she can sell to both investors and private citizens who want to live in a property. You will need to see if there is a termination of the lease upon sale clause in your lease.

Unless you live in an illegal apartment or there is some other technicality, my understanding is no. That property is a business (rental) and a potential buyer buys it contuning with the business agreements in place (your lease). When I purchase a property the leases currently in term are a big consideration. |

The lease is a binding contract that the landlord cannot break just because they want you to leave. However, many landlords that want to evict a tenant may try to find reasons to evict you. Reasons such as not keeping the property clean, having loud parties and being a general nuisance. In your lease there might be several clauses that give the landlord the right to evict you if certain conditions apply (read the fine print). If anything, he may just wait it out until your lease runs out, and he doesn't have to renew it. When the landlord is showing the property to prospective buyers, ask the buyers or the landlord if they are planing on evicting all the tenants or if the new potential owners would like to have you as a tenant, it doesn't hurt to ask. I know about evictions because I am a Deputy who works in the civil process office. |

No. It's a leasing agreement, sort of like a "contract". he can still show the property around, and offer the buyer to rent it out to you while you are still under the lease. if not, then the buyer would have to wait it out. Also, the landlord is required to give you a 30 day "written" notice that the property will be sold, once the lease has ended. It does vary by state, each state has their own rules when it comes to renting, and leasing. However, that information is pretty much accurate through out. |

Your lease agreement is with the current owner, and therefore would terminate the day the escrow closes with the new owner or the date your lease terminates, whichever comes first. While you may be able to work out an agreement with the new owner, he is under no legal obligation to do so. |

Yes! But they have to give you at least 30-days notice.
When he sells the property he has to disclose that someone is living in the home under a lease and most buyers will understand. But in most cases, you only get 30 days to move out once an offer has been accepted.
