Can my landlord evict me immediately?
We live in Oklahoma. We signed our lease two years ago. The lease stated "I agree not to have any pets inside or outside." My husband got a dog that stays in the house. At the bottom it says "If, for any reason, one or all of the above agreements are broken, I will lose my deposit, and my landlord may remove me at once."

Doesn't he have to give us a 30 day eviction notice? I am freaking out because I have two small kids in the house.

The landlord does know about the dog and the dog is staying with family until we find another place. My husband brought the dog home without my knowledge. We had been needing a bigger place anyway, I just need 30 days to find another place and get moved.

Do you think if we told him we would be out by the end of the month he would just leave us alone until then?

i don';t really know if he has to give you thirty days notice or not,

I believe that the landlord can give you more like a 24 hour notice to remove the animal or face eviction.

let me ask you this- Landlords have faced huge losses due to pets, Do you really blame him for this when he was upfront about it when you moved in????

It depends on the state laws. It usually take 30 days or more to complete the eviction process. Instead of stressing out and putting your small kids at risk of being homeless and losing your deposits why don't you get rid of the dog or find someone to care for it until you can find a new apartment or house that is pet friendly?

Did your landlord find out about the dog and threaten to evict you, or are you just freaking out because your husband got a dog and you're not supposed to have one? If the latter is the case, I would suggest calling your landlord and discussing the situation with him/her. Sometimes they will be more lenient or ask for additional rent each month--if they don't already know about the dog. Just tell them you're "thinking" of getting one and were wondering if it would be permissible.

If your landlord has threatened to evict you, you have the choice of either packing your bags or getting rid of the dog--you did, in fact, break your agreement, and your landlord is not required to give you notice because you signed on the dotted line indicating that you accepted the terms of the lease.

"Immediate eviction" MAY be possible if you are breaking drug/prostitution laws, but otherwise normal eviction laws apply. Be prepared for forfeiture of your entire deposit and assessments for damages and other legal action.

It's interesting that your husband has forfeited your children's home to take in a dog without consulting you. I trust you are freaking out over him more than the landlord.

Because the lease doesn't specifically say how long "at once" is, I don't think your landlord can evict you without 30 day notice. Typically when a contract is too vague, the courts will decide against the person who wrote the contract. Plus, when a contract is written, I don't think you can go against the law, even if both parties agreed to it.

If it says at once in the lease you will not have 30 days but you should have a few days. The problem at once could mean 30 days to one person and 1 hour to the next. Since it is not cleat I would just start looking for something else asap.

As a former landlord (of course different state laws apply) I would serve you with an eviction notice upon knowledge of your breach of contract. If you refused to vacate the premises on your own accord I would go through the formal eviction process... If in that process I incurred any additional debt due to your negligence I would take you to court to recoup my losses...

You say you are worried because you have two small kids in the house... You really should have thought of that BEFORE bringing a dog into the house when the lease SPECIFICALLY states you cannot have a dog- inside or out... I would advise you look for another place to live

Well you signed the lease with it saying that, they can remove you at once. So I would think that they can evict you right away. If you refuse to leave though, he will have to go through the courts and that will probably give you enough time to find a new place.

I don't understand why you took that risk in the first place if you have kids at home... I hope the dog was worth it.

It seems the landlord is required to provide you 30-day termination notice and 14 days to remedy the breach (i.e. get rid of the dog).

"(1) Except as provided in the Uniform Residential Landlord and Tenant Act, if there is a noncompliance with section 76-1421 materially affecting health and safety or a material noncompliance by the tenant with the rental agreement or any separate agreement, the landlord may deliver a written notice to the tenant specifying the acts and omissions constituting the breach and that the rental agreement will terminate upon a date not less than thirty days after receipt of the notice if the breach is not remedied in fourteen days, and the rental agreement shall terminate as provided in the notice subject to the following. If the breach is remediable by repairs or the payment of damages or otherwise and the tenant adequately remedies the breach prior to the date specified in the notice, the rental agreement will not terminate. If substantially the same act or omission which constituted a prior noncompliance of which notice was given recurs within six months, the landlord may terminate the rental agreement upon at least fourteen days' written notice specifying the breach and the date of termination of the rental agreement."

The landlord is liable to a penalty three times the rent if he illegally evicts you (i.e. forces you out, turns off utilities, etc.).

I don't think that your landlord can evict you immediately, even with that language in the lease, because it would violate the law.
