C-ROD | Can my landlord increase my rent before my lease is up for renewal? |
Additional Details There was a "lower rent" discount that I was receiving and the landlord got rid of it because supposely he got audited and this discount is not suppose to be there. (I'm in NY)

It depends also a bit of the state you live in. Even if your landlord put a clause in your lease saying he could increase it, that would be largely unenforceable in my state (MA).
You need to look at your state laws and then more specifically your City's laws. If you live in a large metro area, likely there are other statutes to consider. |

Heather is right about the lease stating whether they can raise rents. I would recommend reading your lease and finding out what it says about it. If they are illegally raising your rent then I would consult an attorney asap! |

Not unless it specifically states that he can adjust it in the lease. Check your lease and if you are correct, point that out to him. He can raise the rent if you renew though, starting with when the new lease goes into effect. (And if he has given you enough notice - usually 30 or 60 days depending on your state.) |

Yes
If your lease is for longer than a year. A landlord in BC Canada must give 3 clear months notice to raise rent once in every 12 month period.
If you were in a lease that would fall into a monthly rental at the end of 12 months I as the landlord could then 3 months prior to your lease ends give notice of the increase.
I hope that you find this information helpful.

No. Once the lease is signed the terms are not changable until the lease comes up for renewal.
There should be a part of your lease that explains about rent and increases.
Rent can be increased at lease renewal and you should receive a notice prior to the end of your lease advising you of any rent increases. |

usually no....that's the purpose of a lease term. It locks in your rate for that term. Def read your lease. If it's not in there, get a good attorney. |

No way. That is what a lease is for there is no way they can legally increase the rent. That is unless you are on month to month.
One of the few rights you have is a tenant is as long as you pay you lease on time they can not raise the rent or make you move out.
One thing to consider though is a landlord can make you life there terrible. You may want to mention to you landlord that if he pays some of your moving costs you will consider moving early and he can rent then at the higher price to someone else. After all they would want money if you broke the lease you would have to pay. At lease then you can move to someone who appreciates you. |
