Can my landlord keep the full final months rent if we stay there only 9 days out of 31?
We are leaving our rental property on October 9th. Today the agency has taken out the full month's rent for October (800£) out of our account. I have called them to ask when the difference would be returned, since we will only live there for 9 days. They said they would need to work out what work needs to be done to the property first and then once they have all the invoices etc, they will return the difference in rent.
But thats what the deposit should be for, and they are keeping that as well until all the work has been done.

Can they keep the final months rent in full even if we only live there for 9 days?

yes they can, and will. you cant rent a place for 9 days only and they cant make up the difference by renting it for 22 days.

That would depend on when your lease is up. If your lease is expired then typically no, they would have to prorate. However, if your lease is up at the end of the month abd you are moving at the beginning then yes they will keep the difference. Thats why they collect the last months rent to secure them that you will not skip out early.

Yes, they can. If you check the lease, it usually reads something like the landlord will not agree to prorate the final month. This is very common.

The reason behind it, is that landlords have a very, very difficult time renting an apartment mid-month.

Yes they can. Most contracts state that the rent is not pro-rated for any reason. Besides, did you sign your lease thru the end of the month?

I am afraid you are not going to see a return on your hard earned money unless the landlord has a heart. Most rental agreements require a 30 day notice to leave or have a contract of say 12 months , for example and you can rarely break the lease agreement without taking a loss.

Yes they can.

You'll probably find that you have to pay the full month's rent even if you only live in the flat for part of the month.

If your contract expires after the 9 days, you are liable for the rent, if you have no agreement, you have still lost the rent, better to have cancelled the direct debit, but hindsight always has been a wonderful thing!

true that is what the deposit is for. It depends if you have given them your full notice if you have then I'm quite sure that they cant call your CAB and see if they can advise you

deposits can not be used in place of rent. They are for damages on the property after you leave. Your prorated rent and deposit should be returned after you move out depending on the condition of the place and what kind of lease stipulations and notice where given. I know it's not the answer you want to hear but it actually sounds like the agency has done the appropriate thing here.

If you broke the lease than yes, if you did not than you should only have to pay a prorated amount. That is not fair and you deserve a lot of your money back.
