I think this is a "pay or quit" notice. If so, this is the beginning of the process, and if you don't pay the money within 5 days that will start the eviction process. The eviction process can go from around 20 days to 60 days, but if the landlord does anything wrong (or your courts are just backed up) it can go alot longer.
Regardless, it sounds like she does have the right to evict you if she is the owner, even though your lease was signed with someone else.
So, you are going to have to leave eventually, and probably pretty soon. Better start looking for a new place and fast. |

Patti P is right. You can get a 5 day notice, but no one can really be expected to leave in that short of time. If just puts you on notice. They will file through the court and you'll have 30 days. In PA it's a 3 day pay or quit, not 5 |

Pay your rent! We give 3-day notices in Florida - that's 3-days to pay your rent or move. In 3 days, the landlord will go to the courthouse and file for an eviction. You will be served papers and have 5 days to respond at the courthouse. The landlord will then have 5 days to respond to your response. At that point, the eviction is set for a hearing and you go talk to a judge. The judge will likely agree with the your landlord as you haven't paid rent in 2 months. The sheriff will then go the home and you'll have to leave immediately. The landlord can then go in and remove all of your possessions from the home. |

If you rented from him and he no longer is your landlord, and you have not paid the rent then you have no choice but to move before they set your things out. Even though she is not the one you have a lease with she is now the new owner. Is your lease month to month? It sometime take the legal system a while to go though the paper work But I would not chance that. |

In Illinois, it is my experience that no the landlord cannot remove your stuff. Instead what happens after the five day notice is that the eviction proceedings begin. If you want to continue to live there you're going to have to pay rent to the rightful owner. If you paid the wrong person you should see an attorney about recovering the money from the man who opted to not buy the place. |

I'm not sure about the latter part of your question. But I do know that they cannot make you move out in 5 days. That is just a notice. If you don't leave within' the 5 days, then they file a complaint with the courts and have you evicted legally. If she was evicting you simply because ownership had changed, you could get a longer stay. But since you have not paid your rent for almost two months. That is a definite eviction through the courts. |
