Doesnt he have to give us a 30 or 60 day notice first? He put a 3-day notice on our screen door when we weren't home. We've never received anything else before this. We've lived here over a year.
And doesn't he have to have us personally served, not just leave it on the door to blow away in the wind? (Its really windy right now and it was barely hanging on by the corner when we arrived)

We're just trying to make sure he's starting this the right way. But it sounds right I guess... (by some of the answers) 3-days, then he gives the eviction notice.
One of our main problems is where he just left the 3-day notice on the screen door and it almost blew off before we got there. Isn't that supposed to be served too?
We were honestly expecting an eviction at some point, we just expected him to go about it a different way, he had already spoken to my husband and they had a plan all worked out to avoid the paperwork and negative remarks on our credit. I guess he changed his mind and decided to screw our credit up anyway...

The 30 day notice is if he is simply asking to you to move. He is sueing you, and you have 3 days to avoid the lawsuit (eviction).
In CA posting on the door constitutes legal notice of the intent to evict. He could not do it any other way, regardless of what you thought he would do. He has to serve you in writing, and if you do not answer the door he has to post it. I personally post it on all doors, garage, and back door.
Your formal court papers will be served, but again, if you can not be located they can post those on the door and mail them to you (he has to do both). |

This sound like a 3-Day Notice to Pay Rent or Quit. If the 3 days expires, then he can file an Unlawful Detainer (eviction). After you get served with that, you have about 30 days before they lock you out.
ADDITIONAL INFO:
Yes, he can leave the 3 day notice on the door. The Unlawful Detainer needs to be served upon you by a process server.
As far as the credit is concerned, if a judgment is filed, it will show up on your credit report as such.
Make another attempt to work it out with the landlord before you get evicted. Good Luck. |

Landlords in most states can post to your door a 3 day pay or quit notice. His next step is to serve you with a 30 day written notice. You can drag it out and force him to take you to court where a judge will grant you an additional 30 days,but everyday that you stay there you are responsible for rent and if it does go to court you will be resposnible for the court cost. |

Yes, 3 day notice to quit. This is the legal approch. Your Landlord is following the written law. And don't blame your Landlord for your credit problems. Only you can ruin your credit..... don't blame it on anyone but yourselves. |

If your rent is late he can do this....It means you have 3 days to TALK to him about why your rent is late. If you do not, THEN he can start eviction proceedings which will take 30-60 days for the police to evict you if they have too. Talk to them and see what the problem is. If they evict you they have to have a reason, if not, it might be discrimination...... |

Check with the local housing office and find out the exact laws pertaining to rental homes. Some states say a landlord can give 72hr notice, other states say an eviction can only be done by going to court.
Also, read your lease and see what it says. There should be something there stating how much notice will be given in the event the lease is breached. |

It depends on what kind of a notice he's giving you. If he is planning on evicting you through the proper channels by filing an unlawful detainer, he has to give you notice that he's going to file usually at least one week in advance, then fill out the paperwork with the court and serve you with the summons to the court date (you have to be there to be served and it usually has to be an uninterested party). If the judge decides to issue a writ of recovery, the sheriff can then come and physically remove you from the premises according to the timeline laid out in the writ, thereby executing the writ.
Check with the Attorney General in your state, they probably have a FAQ site that give you more details. |

Yes, it starts with a 3 day notice-in order to satisfy proper service, he must hand it to you personally, give it to someone in the unit of legal age (over 18), have it served to you personally by a process server or post it in a conspicuous place (like your front door) AND mail a copy to you. |

unless you didn't pay rent he CANNOT give you a 3 day. If you've lived there less than one yr, the must give u at least 30 days, if it's over one year, then it's a 60 day notice to move out. |

he can't serve you at all' he needs to go through the court and a sheriff will serve you. In the mean time contact the county dept in your area for landlord tenet problems. but you need to put your rent payment in an escrow acct at a bank. The court will want to see your records. If you don't have the rent you will have approx 30 days after he files with the court and you speak with the judge |
