Can my landlord raise the rent when another person moved into the extra bedroom can he do this?
There are three of us on a lease for a four bedroom house. The advertisement said that it was a four bedroom for $1350. Now that we had a fourth move in he wants to raise the rent $250 dollars which I think is extreme.

Read the lease.

Getting to the heart of the matter, there are three of you on the lease. Your lease probably limits the residents to those three people. It doesn't matter whether the house itself is a 2-bedroom, 4-bedroom, or 6-bedroom. The landlord and the three people on the lease have agreed to a binding contract.

Most such leases will define what a "visitor" is versus what a "tenant" is. Most also specify that all persons over the age of 18 must appear on the lease. The fourth person clearly would be a tenant, not a visitor.

Bottom line: if you move a fourth person in, you're violating the terms of your lease and are subject to eviction. Your landlord has offered to modify the terms of the lease to accommodate you.

Further, $250 actually strikes me as very reasonable. With the three of you, each was paying $450. With the four of you, if you average the rent, each is now paying $400. I don't see anything extreme in that.

Your main concern, though, should be that you'd be violating the lease (that the three of you agreed to) if the fourth person moves in...and you'd be subject to eviction. The landlord's offering you a very fair deal.

READ the lease!
It probably says NO other tenants, so if you move some one else in YOU are violating lease terms. Choice is to move that person out or to negotiate with LL on rent. Both you and LL are bound by terms of lease and they cannot be changed once signed, except by agreement of both of you (LL and Tenants).

If it says he can on the lease, then he can.

As you are the ones deciding to alter the lease he can also make changes. You are essentially voiding the lease for 3 people and starting a new lease.

The "normal wear and tear" on his property just increased by 33%, he raised the rent for less then that.

If you think it is extreme you should move somewhere else.

It all depends on what your lease says...most of the time, they can raise the rent if someone moves in that is not stated on the lease. Typically it is 10% more. But it also depends on what utilities the LL pays, he may charge more if he pays water, etc.

Do you have a lease or rental agreement that addresses this? If so, both parties need to abide by it. If not, you are renting month-to-month and the landlord can increase the rent.

That sounds iffy. The house was designed for at least one person per bedroom and it is reasonable for you to assume that you can fully use the property. Of course, the additional tenant will have to apply and be approved under the same criteria.

Also, your landlord may be violating Fair Housing laws. Landlords cannot discriminate against families by changing the rent.

if you have a month to month rental they can raise the rent otherwise they would have to wait until your lease runs out in order to raise rent unless they have a clause stating it can be raised.

Since someone not listed on the agreement moved in you could also be evicted.

I'm sure he can raise your rent, just like he has the power lower your rent, or even kick you out. But i also think $250 is extreme because there's no way 1 person would use 250 dollars worth of electricity, water, or gas in a month
