Can my landlord refuse to allow me a window air conditoner because he just installed new windows?
This is a 2nd floor apartment and I have 2 small children. I would buy my own air conditoner but he won't allow us to install it. We pay our own electricity.

Can you compromise? Can you offer to pay to have it professionally installed on it's own ledge?

He's afraid of damage. I bought a house where a window unit was not installed correctly and the water from the condensation rotted the window sill and ruined the drywall under the window. An inproperly installed window unit can cause a lot of damage.

You rented the apartment without an air conditioning unit. Installing one would mean having to make structural changes to the apartment. He is probably well within his rights to refuse this. How long have you lived in this apartment and why would you rent it without any way to cool it?

I'd check with renter agreements of your state. Google "Renters agreements" with you state name...look for Landlord property rights.

yes he can. buy one for inside they cost a lot more but they work well and they will not do any damage to the windows.

Sure, he can refuse to allow you to make any change to the interior of the apartment unless they have to do with ADA (Americans with Disabilities Act). This would only include handicap bars in the bathroom, wider doors, etc.

Look into renters law. In Texas that would be illegal due to the extreme summer temps. You probably have a legal right to put an AC in.

As the others are saying, check the laws in your state. Also, perhaps ask other people in your apartment complex. In the end, however, if you CAN put in the AC unit, you will probably have to pay for any damage done, and that may include a new window. So keep all those factors in mind. Good luck!

First, a previous poster mentioned something about it being permitted if you could qualify under the Americans with Disabilities Act, but advised that this only applies to things like bathroom fixtures. However, it should be noted that you can qualify under the ADA even if you do not have a physical handicap that would require a rail in the bath tub. People with allergies or asthma that is severe anough could qualify for coverage under the ADA. Also, if you or your children have allergies or asthma, an air conditioner will clean the air a bit better.

Second, short a disability, your landlord can prohibit window units, though this would depend on your location. Some previous posters noted that in warmer states this prohibition would not be permitted, so check with your health department. They should be able to at least direct you to the office that can answer your question.

Finally, you could invest in a portable air conditioner. They can go for upwards of $500, but are well worth it. We jsut bought one last night because our air conditioning in our apartment is crappy. It won't cool you whole apartment if you have a large place, but it kept our large bedroom very chilly last night. You have to vent it out the window, but it is very easy to do, and it doesn't do any damage to the windows.
