Yes and no. At the moment, you are safe. However, if you are late ONCE more on your rent, or violate your lease terms in any other fashion, you can be evicted, lease or not.
Bear in mind that 'notice to the landlord' that you will be late with rent is STILL a violation of your lease agreement, unless the landlord responds in writing telling you that they will accept your notice.
Stick to the terms of your lease religiously, and you cannot be evicted.
Be cautious of other advice offered here. A landlord is NOT required to include the terms of your lease to a new owner if such is not included in the terms of sale. Generally speaking, nearly ALL landlords do so, since the landlord is STILL bound to the terms of a legal lease, even though they no longer own the property involved in the lease. If this woman should sell this property without including your lease, THEN you can haul her to court for expenses incurred in moving, since you still have a valid lease which she cannot honor, since she sold the property covered in said lease. If she's THAT dumb, you can have a field day with her in court. |

Now read the lease even if it has a clause that only allows the landlord to break a lease to sell, in my opinion it would not be a valid provision since it lacks mutuality IE only the landlord can exercise the provision, but talk with a local lawyer who does landlord tenant law
Next issue: showing the unit, hold the landlord to the reasonable notice requirement, usually 24 to 12 hours before hand, some RE agents do not obey this, also do not let the agent to ruin your weekend by having showings all day on sat and Sunday,
On paying late, total different issue, if you are late in the future do not be surprise if the landlord moves for eviction the day after rent is due and owing in order to try and force you to move |

As many have said, the landlord could sell to a new owner, but you would almost certainly have a case for a lawsuit against the current owner if the new owner kicked you out.
Even with a late payment there is still an eviction process. They may possibly be able to evict you, but if they did it would certainly take more than 30 days. |

I'm not positive about Florida law, but in Michigan, the landlord has to send you a "notice to quit," which gives you at least 30 days. Then, there is a further step if you are not out. It can drag on for several months. I suggest you look in your phonebook for a landlord-tenant association which can answer your question for Florida. Or call Legal Aid. |

Yes the landlord can sell the apartment. However, she probably has to give you a reasonable notice period. And, I'm not sure she can make you leave BEFORE the place is actually sold. It may be that you are entitled to compensation for the inconvenience of leaving before your lease ends. The terms of the lease you signed will also determine your rights in this matter.
You should check your phone book for a tenant action council or advisory group in your area. |

No, she has to honor your lease, assuming that it is in writing. Any lease longer than 1 year must be in writing to be enforced. If you paid any back rent before you received any notice of eviction then you are current and it doesn't matter. There may be a provision in the lease about how much notice she needs to give you to terminate the lease upon a sale of the property so check the lease in detail. |

If you have a lease that is valid until October 2009, then DO NOT MOVE.
She cannot legally make you move nor can she have you evicted.
The new owners MUST honor the lease, and I would make sure she knew that so she doesn't get into trouble putting the house on the market under false pretenses.
Hang on to your copy of the lease....that is gold. |
