Can my landlord show my apartment every day from 11am-4pm?
I gave my 30-day notice and now my landlord wants to show my apartment every day from 11am-4pm. He gives me 24-hour notice for each showing, but there's a new notice every day for the next day! Do I really have to let him show the apartment every day for 5 hours? I feel like I shouldn't have to pay rent if I can't reasonably use my own apartment for the last month I'm here...in CA

I manage rental properties in California. Although the landlord can show the property to future tenants, he cannot abuse his power. California Civil Code 1954(c):

You also can stay there during this time and you cannot be forced to leave.

I understand what his concerns are and yours. I suggest you verbally allow him to show the place between 10AM-5PM (or whatever hours during the day you're not home) and give you 1-2 hour's notice before showing up on the days you are home.

I can't imagine he has a tenant every day that is interested in the place. I think he's just new to landlording and wants to protect himself, but he's becomming a pain in the *** by doing this. I bet you really don't mind him showing the place, but you object to his notices and making you feel weak.

Am I right?

yes he can do that and if you refuse to let him show it then you are in breach of contract.

As long as he gives you notice...then yes it perfectly legal. And no, don't mess up the apartment.... it's in YOUR best interest that it gets rented ASAP...so the showings will stop. And yes...you still have to pay rent as long as you live there. I know it sucks but that's one of disadvantages of renting.

Yes, he has a right to show it. If you gave him a 30 day notice, then you should be in the process of moving out during the 30 days. Do you have the key to another apt so you can move out? I always waited till I had the key to another apt before I gave my 30 day notice. Then I used the 30 days to move out. You still have to pay rent for that 30 days though.

This is an unreasonable request from your landlord and you do not have to accept it. Check tenant/landlord rights you have more pull then you think.

i would say the frequency of the showings would be a problem, even though proper notice is given, i believe the 11-4pm is to broad

now the problem is it is probably case law which will deal with the frequency issue, need to call around for a tenant's right group to see if you can find actual case law on this or try the attorney general of ca give them a call

If I were you, I'd mess up my apartment (not dirty, just make it messy) for the next couple of times that he brings somebody over. That should stop him from doing it. Also, most contracts specify that you cannot refuse "reasonable" requests for entry; I would have to say that daily requests to enter are definitely UN-resonable, and tell him "no." If he continues to bring people over, use your freedom of speech, and complain about how he has been coming into your apartment EVERY day to the potential renter... You get the idea ;-) Good luck!
