FoxyRox | Can my landlord spend my security deposit after 1 month I have left? |
The day I left, my landlord had told me that we will keep in touch about my security deposit, asked for a forwarding address and wished me well.
Almost an entire month has passed, and thus far he has sent me an email stating that he will spend my security deposit on a few things he thinks need to be done, like replacing some locks for a key I lost and cleaning up my room, which was clean when I left.
My question is: The 21 days for him to either return my deposit or send me the expenses receipts have passed, and no receipts have arrived till now.
Is he allowed to spend my money past the 21 days he is supposed to return them to me?
I am suing him in Small Claims court. Will a receipt dated past his due return date be valid?

Yes the receipt will be valid. It is not always possible to get a repair person to the premises that quickly. Changing the locks because you lost the key is very expensive |

If the landlord has a time limit of 21 days to refund your money or send you a bill showing where your deposit went then a receipt after the date will not be valid in court. The time frame for return of your deposit is non negotiable for the landlord and they can not exceed it if they want to keep your deposit or part of it. |

In some states (LL friendly states) the deposit limits are negotiable. A judge will look at the receipt to see if it was a necessary expense before automatically denying the claim on your deposit. If the LL can show that it was needed (with photos or statements from contractors or service people) and that it was your fault, it will likely be allowed. As another poster said, some repairs take longer to get service people to do. (For instance, roofers and AC guys take weeks at this time of year to get to your job.)
5 states allow 21 days to return a deposit. Some of those require the 21 days to be counted from vacating, at least one says it is 21 days from when he received your forwarding address. Make sure this period is up before proceeding.
Then I suggest before you file in court that you send a demand letter to the LL for your deposit. Send it certified, rrr, and keep a copy * the postcard to show that he got your letter and refused to respond. Why? Two reasons. 1) Failing to respond to such a letter can show bad faith on the LL's part and entitle you to double or treble damages in certain states. Make sure you then ask for any other damages you to which are entitled when you file the case. And 2) judges like to see that you attempted to resolve the issue yourself before resorting to court. It makes you appear more reasonable and the LL less reasonable. |
