Can my landlord successfully hold my money for this?
i had left a place that i had rented with my animals. when i did the walk through i was told that it smelled like pets. i tried to clean up the pet odor as much as i could and left the windows open to air the place out. before moving into there originally the landlord had said in emails that they were going to replace the carpet and we said that wasn't necessary because we didn't want to be responsible for carpets. they were never changed and are from the 70's and then a month after moving in i found out they were selling the place. With the place possibly smelling like dogs and if the ppl want the carpets changed who are buying it are we responsible to cover the costs even tho the carpets are old? we were told that we would not be responsible for the carpets when we signed a lease but we never got that in writing. also, we were told that the previous tenants had a dog. so could i get away with not paying?

If that carpet was from the 70s, they cannot charge you for replacement of the carpet. They have to take into consideration fair wear and tear. The life expectancy of carpet, best case, would be 10 years. The prorated value of that carpet would be 0.

Also, the email that proves animals lived there before you shows that the odor was existing.

I assume the landlord sent you a detailed list of damages and the charges. You should respond in writing to dispute the carpet charges. Indicate the excessive age of the carpet and the pre-existing animal damages.

If you take the landlord to small claims court, he would not get the full cost of replacement for carpet that old.

Sorry it doesn't matter if he was going to replace the carpet or not. If your lease does not specifically say you are not responsible for the carpet then you are. And yes he can hold your money for it.

If you alloweed the place to get smelled up that bad he will properly have to klez the walls as well. Not fun.

even if you have to pay it would be almost nothing and mabe nothing at all--even if you went to small claim court the judge would consider deprecation and probably give them nothing.a carpet from the 70's is worth nothing. get your deposit back and if they refuse tell them you are going to sue in small claims court and you include court cost in the suit. i think they will back down. and let you go scott free. they are trying to bluff you.----good luck

It sounds like your dog urinated on the carpet which is your responsibility to not let that happen. Just because there was a previous animal does not mean there was pet odor when you moved in. Had there been a pre-existing odor, then you should have made sure it was documented on your property condition report when you moved in. Also, just because a carpet is from the 70's, doesn't mean it needs to be replaced; some carpets last a long time as long as it is cared for; which in your case, it wasn't.
As a landlord, I can tell you that one of the biggest headaches (and cost) in turning over a unit is pet odor in carpets. The carpet not only has to be replaced, but the pad underneath has to be replaced ( pulling up pad held down with hundreds of staples is NO fun) and then the floor has to be painted, at least twice, with Kilz to ensure the odor doesn't come back up through the new padding and carpet.
Yes, you are responsible for the new carpet and all the costs associated with it that tenants don't think about.

In the US, the landlord can get the Fair Market Value for the carpet, in general most courts place a life span of carpet at seven years, therefore if the carpet is over seven years old the landlord should not charge to replace the carpet, no matter who is at fault

you may want to consult a local lawyer to see what judges do in your area for life span, but if the landlord fails to return the security deposit within you states time frame then small claims maybe the route you will need to take

You are screwed, They have your money. Without it in writing it really isn't worth the trouble of going to court.

If your pets left a smell in the apartment, then, yes, the landlord can charge you. If your pet urinates on a carpet, and even if the carpet is yanked out, and replaced, the urine smell still reeks in the floor beneath the carpet. You are responsible for that.

read your lease, whatever it says, is what you have to do! ALWAYS get things in writing!!!

You could easily be held responsible. Opening a window does not help with pet odors. But, you would not be charged for the full replacement, but a prorated one.

Don't count on a judge even looking at your emails. Email can be forged by a 5 year old is not "documentation".
