Hi,
Yes in fact they can do this. If your pet caused damage up and beyond the damage deposit the Landlord has every legal right to seek payment for damages. When will people realize that pets cause damage. That carpet could cost thousands to replace. Even if you gave a pet deposit, it wouldn't cover the cost of replacing carpet. If the unit is unrentable due to this damage the Landlord can ask for lost rent due to your neglect. |

a person can sue for pretty much any reason. whether or not they win i cant say. chances are your pet did stink but you just cant tell. my friend had 3 cats and thought that her place always smelled clean but it always smelled like cat poop. |

most likely they can. but if you paid for a pet deposit it should cover expenses like this. but the answer is most likely yes.
but you should first have the opportunity to have the existing carpets cleaned. then if that doesnt work, then you may have to replace them. |

yes they can; becuz you lived in it and its ur dog fault; and its defacing their carpet (which by the way is illegal in any apartment ownership) good luck th replacing it |

fun. usually they wait until the end of your lease before cleaning up after you. it must be some stinky dog.i suspect that if they did sue you, they couldn't get much more than the cost to replace the carpet. they have a duty to mitigate their losses, so they should replace the carpet and then sue you for that cost (or apply the deposit).
but since law varies from state to state, definitely talk to a lawyer from your state.
and don't take legal advice from a paralegal. they are prohibited to practice law. |

They can charge you for replacing or cleaning the carpet if your pet ruined it but not for lost rent. |

That depends, I know of a lot of people who act like the havea paralegal and actually are posing as one themselves. As far as lost rent, did you pay a pet fee at the begining because that is supose to take care of any damage the pet does during the stay. Was there a writen contract? If there was look for any loop holes or if your renter broke any of the agreements in the contract. If they break even one thing it is called breach of contract and there for null in void meaning you don't have to go by or be held accountable for anything listed in the contract (incuding pet issues)!!! |

did you have a pet deposit? If you do then they can't make you pay for carpet. The land lord sets the pet deposit. Either way I don't know of an attorney that would take such a case. Tell that douche bag to shut up. |

You do not need to replace the carpet.
After you leave your apartment, have someone come in and steam clean your carpet. Save the receipt. Take photos.
Carpets last seven (or so) years. He would be able to charge you for a new carpet if you have been there a seven to ten years. I can not see how he can charge you for a new carpet, unless it is REALLY, REALLY bad. If he wants, he can replace the carpet on the day AFTER your lease is over.
Let him sue you. I do not see how he can win. Ignore his paralegal and his attorney. Only worry about this if he sues you. Or he withholds your deposit. |

YES. and i don;t think your landlord would lie about your pet smelling,he is making money off you why wud he make up that. but if you dont like it maybe you shud get your own place and pay morgage than you can bask in the ambiance of your smelly dog and be care free about law suits. |

To the best of my knowledge, this is what your security deposit is for - any damaged you or your pet has caused during your time there. If your landlord acknowledged in your lease that you were allowed to have a dog, then the worst he can do it keep your security deposit for any and all damage that has incurred. I do not believe he has a case against you outside of this. Talk to a lawyer anyway - I think they are just trying to scare you. |

your security deposit is supposed to cover replacing of carpets. call a lawyer - i think its illegal for them to sue for "lost rent" and its probably a scare tactic. |
