Can my landlord tell me who I can have in my apartment???
My landlord did an inspection of my apartment last night because the neighbor's told her my boyfriend has been "staying there". I told her I have some clothes for him and shower supplies so he can go out with me when he comes over right after work. We both work a lot and dont see each other much. She told me that I lied to her when I signed my lease in january because I told her I was single (I was at that time). We spend little time at my place, mostly we just have sleepovers cus of our hectic schedules (we both work like 70-80 hours a week!!), and we are pretty quiet and keep a low profile. My lease says nothing about guests other than they cant break local laws, but now my landlord is telling me that she "allows" me to have friends over to visit, but they are not allowed to spend the night, especially my boyfriend. She said he is not to spend any nights there, that he has to go home and not sleep over. Do I have to listen? I'm an adult, my rent's on time, Can she evict me for this?

Sounds like your landlord is a real control freak. No, she can't prevent friends from staying overnight. This is a free country as far as apartment living anyway. She can't evict you for that but she may try and you will probably have to get a lawyer to defend you. I would just move out and find another place to live.....)(

Certainly not in the UK, you're (most likely US.) laws are based on ours so I shouldn't think so.

Right of Entry

In general, with tenant consent, a landlord has a right of entry to inspect the premises; make repairs; supply necessary or agreed services; or show the property to potential tenants, purchasers or contractors. Entry is limited to reasonable times, and two days' notice of intent to enter is required. A landlord may enter the premises without the tenant's consent if an emergency or abandonment occurs, or if the landlord obtains a court order. A landlord may not abuse his or her right of access to the premises to harass a tenant.

Your landlord can't tell you who to have in your apartment, read your lease and check. As long as you pay rent on time, it should be no problem. In your state check out tenant/landlord rights. Good luck...

In India we have certain covenants running with the lease, like the ones you mentioned...so if the tenant violates them, the landlord can take legal action.

Does your lease say anything about over night guest ? If not she's off her rocker! As long as he can prove he has his own residence such as utility bills,etc I wouldn't let her push you around. Straight up get out the lease next time she approaches you on the subject and ask her where it states you cannot have over night guest.
If she continues to bother you tell her then maybe we should turn this issue over to the local courts. Tell her she can file eviction and you'll be filing harassment charges.

is this an apartment? are you living in someone's home? are you sharing a house or room? She can try to evict but it will be a messy court battle. be sure that when the lease is up she won't renew and force you out. Single means not married on contracts. Sounds like she is an old fart and needs to grow up.

Hell no! She is abusing her power as your landlord. Most apartment leases have a clause that states guests cannot stay more than two weeks straight without being put on the lease. Stand up to the shrew and tell her who you have visit you is none of her business, and that you will report her to the housing authority if she doesn't back off. He isn't living with you, and the occasional sleepover is not against the lease.

As your lease states nothing about guests, I do not think your landlord has alot to say of who can and can't stay in your apt. If that were the case, your lease would specifically state an additional charge for 'guests'. Stand firm and point out these facts if need be. Maybe this person is on a power trip and feels they can attempt to manipulate you.

Your lease says it all. What if it was your brother or dad coming to stay for a visit? What if you got married and he moved in permanently? what does your lease say about these things? You are paying for the place you live and she cannot tell you how to live your private life. If your landlord gives you too much trouble I would get one of those free consultations with a lawyer and show him/her the lease and when you find out that your landlord is wrong then you have some leverage.

You'd better read your lease very carefully. My lease specifically states that, a "guest" may not stay more than seven days, or a total of fourteen days consecutive in thirty days. Unless he or she is on the lease, we can't have guest overstaying. It states that is a lease violation.
