If your mom's name is not on the lease, then yes he can kick you guys out. However, if you have been living there and that is your permanent residence, most states require that he give you 30 days to get out (because they assume that is how long it will take to pack and move). I do not think he can put you on the street with shorter notice than that. Check your local state laws. Also, if YOU are not the one that is breaking up with him, you could see if at least you can stay until you find a place (if you are on good terms with him) as it may be easier for mom to find a friend to stay with, than for the two of you together. well There are a lot of variables to this..
How long has your mom lived with the guy?
if she has lived with that person for more than a couple of years... then NO..
Also.. Does your mom Have proof of payments for rent? Or is she is just giving him cash/?
Cuase legally... He can just kick you out. since he is the only one in the lease... Not only that but he can actually lie and say you guys broke in.. or something like that..
But I am sure there is other ways...

Since he is the only one on the lease then I would say yes. BUT if she is giving him $1000 a month it would probably be in his best interest to keep her there as long as possible so he doesn't have to pick up that extra cost. |

I don't think this is a question of ownership but is it a right of common law marriage. In most places you are entitled to certain rights after say six months. |

umm yeah he can- neither of u are on the lease. Considering you aren't real tenants and haven't paid next month's "rent" (i assume..) he has every right to put you out. I suggest using some of the next mos. rent to rent a motel room for now. |

Even though she is not on the lease, she does have tenancy rights especially as she has been contributing to thee cost of the lease. She cannot be kicked out without the ex going through the proper, legal eviction process. |

Well dear it depends on if your mom is on the lease or not. If he is the one who is the lease owner, then officially yes he can. But try to pursuade him not to and ask him to give your guys some time to figure a new place out. May be you should move to a cheap apartment - you can find many in your local craigslist citings. |

Yes, he can if she has no proof of her him him money for rent. Because no in days proof is everything. So make sure she has receipt or canceled check because if his a dick he will tell you guys to go. An the landlord cant fo anything cause the lease is under your moms boyfriends name. |

Yeah possibly if she's not on the lease and they are not married.
There may be state laws that protect someone from short-notice eviction.
In Texas a landlord cannot evict without an eviction notice of 30 days, and that may be appealed. |
