Can my new landlord cancel our signed lease agreement? They sold the home before our move-in date.?

Check the lease agreement for what the terms of cancellation are on the part of the landlord. i think you would have to start a new agreement with the new owners. Chances are that if he was planning on selling he would have in the agreement a clause that would allow him to void the contract if the building is sold. He would have to refund your deposit but i think that is it.

It really depends on the lease agreement.

If it was through, they had to tell you that the home was on the market. If that was the case, they should have a termination policy.

The one that was done when we were trying to sell my grandmother's old house a similar situation came up. Generally, it is common courtesy talk with the person about the agreement and make sure everything is covered. That doesn't always happen though and stuff like that is put in the tiniest print.

If it was just an informal agreement, then it is harder.

Depending on the state, renter's rights can vary a ton. Call your local court house or housing authority. They should be able to help out.

I am by no means an expert on this but are the new owners going to lease also?

If so, I would ask your current landlord(the old owner) for their phone number and try and talk to them to see what they are going to do.

They may be planning on leasing it and you sure would want to be the first to talk to them.

Technically, you now have a new landlord. The lease would still be in effect. Your move-in date does not change.

Realistically, (assuming the new owner expects to live in the house), tell the person who signed the lease that you want your expenses back plus a bit extra for the hastle of now having to find somewhere new to live.

It all depends upon how hard you want to push it.

we had to move out of 3 rented houses because the owners sold them or needed them back. you should have legal rights, though.

estielmo
No. The lease stands and cannot be changed or rescinded.

If they REALLY don't want you to move in you can ask them to buy you out. Sometimes the buyer DEMANDS an empty house and it's up to the seller to provide it. You could make some money on this if you don't mind looking for a new place.

However, if you do move in you can be sure the owners(old or new) will be very upset so be sure you are quiet and clean tenants who are always on time with the rent money.

no the lease tranfers with the sale.

Technically the lease should have stated that the home is on the market and in turn I would never suggest to anyone to sign a lease on a home on the market. But it really depends on what the lease states about early termination. You 100% should get back any and all money you have put down, if it was to be taken to small claims court you should win, but barely anything.

jenfrompen
No. The lease survives the sale.
