Can my roommate prevent me from having overnight guests?
I live in a two-bedroom apartment with one roommate. As my boyfriend and I are in a long-distance relationship, the only way we see each other is to spend weekends together. We would like to alternate weekends. My lease says that as long as he does not stay more than 7 days in a month, it's fine.

My roommate, however, is very religious and is bothered by the fact that a man would be staying overnight in the same apartment (although in a different room).

Can she prevent me from having an overnight guest? Legally?
Additional Details
Our lease says it's fine.

If he doesn't stay over, I will not be able to see him.

Yes she can - if you discussed it before you moved in.

She cannot add to the conditions of the union at her whim - or because of how she feel.

What if you [all of a sudden] did not eggs in the apartment and you refused to allow eggs to be in the 'fridge overnight[?]

No she cannot.

If both your names are on the lease, no she cannot. I would, however, re-think the roommate situation. You are going to have nothing but a moral clash with her over this issue. You might each want to find other roommates you have more in common with. Good luck.

legally..im not sure..
but she should get over it..
it's your apartment as much as it is heres.

are you paying rent?...then tell her to mind her own business.

NO she can not prevent you. If your lease says he can stay, but for not more than 7 days in a month, too bad.

Nope.

damn prudes.

Theres a reason why you pay rent.

Nope. Its her problem if she doesn't like having him there but as long as your name is on the lease and you're paying your share of the rent then she can't do anything.

Its not against the rules of the lease so you're fine.

I don't think she can stop you from having overnight guests. It is as much your apartment as hers. If she doesn't like it when he is there, she can go stay somewhere else for that weekend or deal with it.
Of course, you and your bf do have to be respectful of her privacy when he is there. He can't be walking out of your bedroom in his underwear or something. And he should be careful of walking around the apt if she is in her pj's. You know, common sense kinda stuff.
Good luck to you. This is a terrible situation to be in. I am sure when the lease is up, you will find another place to live or find another roommate.

chicpower
Legally she cannot but out of respect for her you should stay elsewhere when he's here. It's not just a matter of her preference of you guys sleeping or not sleeping together, it's uncomfortable for her to have a "stranger" (to her) staying in the house. When I had a roommate we agreed no overnight stays regardless of the situation out of respect for one another's privacy and feelings of safety and security. That's just part of having a roommate and it's a decision you made when you chose to share rent with someone else.

NOPE. I've had this problem before as well. If it wasn't the boyfriend thing, it would probably be another and seeing as how it's hard to argue with religious beliefs, she's probably banking on you doing what she wants.

Tell her God loves you just as much as her and to get over it or get a new pad. Good roommates are hard to find and her situation could be worse. At this stage in life, you have to be able to co-habitate and compromise. You're obeying the provisions of your lease. If her name is on the lease as well as yours all she can do is pay whatever fines your complex may charge and break HER end of the lease (ie:move out).
The original contract you signed said you'd BOTH be there so she'd ultimately be screwing her self.

No, not legally. Although, how come you didn't suss these things out before you moved in together? Unless, the apartment is only in her name, than yes.

No. I am guessing you both are on the lease, so as far as the legal aspects go, I would think that his staying is dependent on what is written out in your lease.

It is unfortunate that your roommate feels this way, as it is your apartment as well, and you should be able to have him stay if you like. Hopefully the two of you can come to an agreement.

Not like your situation, but my old roommate had her boyfriend move in. That was fine, except that he did not participate in paying any of the bills. Roommate situations can be tricky sometimes; sit and talk with yours about the situation - sometimes a conversation can lead to an agreement where no one is uncomfortable in their own home.

no. she cant if she doesnt like it...then tell her to get a new roommate. you can have your bf over on the weekend that is fine..he can even stay in the same room if the lease says you can then her personal feelings about shouldnt mean anything...tell her to get over herself..not everyone is that psychotic... but if shes gonna be such a brat about it I would think about finding a new roommate whos not such a freak.

sundaizie ♥~♥
NOPE.. YOUR LEASE STATES WHAT YOU CAN DO AND NOT DO. Your roomate can, however, make it difficult for you. she can be snooty...rude...and basically distroy and friendship that the two of you have!
That's her right...and your right is to have your boyfriend there on weekends. She has to live up to her end of the lease..as do you. No one gets to leave..you are both on the lease.. good luck..
signing "leases" with "friends" is not always a good idea. We live and learn...don't we? ♥ ♥

You need to get another roommate...cause this is gonna get ugly...

Taylor's Dad
It depends on what your occupancy agreement or lease says. You should not have your boyfriend stay over, however, out of respect for your roommate.

rich1967a
Have some respect for her. Have him over, but he spends the night on the sofa.
