Ryan | Can our landlord charge us $700 instead of getting our $720 security deposit? |
In Las Cruces, NM:
Our landlord is charging us outrageous prices for cleaning. For example, $30 to clean the dust off a fan. The wall also had some very shallow holes in it from a flat screen TV, so they are charging $150 to fix it, which usually costs about $15 (if I were to have done it).
They also said we could have a free carpet shampoo for renewing our lease, which we never took advantage of, and now they are charging us for a carpet shampoo after we left.
All in all we were expecting 720 back and are getting charged 700, so they are claiming there are 1420 in damages.
Help! Additional Details My real question is:
Are they allowed to charge 30 dollars for dusting a fan, and things like that? I'll have to get the itemized list from my old roommate, but that sounds ridiculous. |

First hopefully you have documentation of the condition you left the unit, then it sounds like your recourse is to sue them in small claims for the return of your security deposit, which in turn they will counter for the extra 700 and a judge will decided based upon the evidence presented at court that day |

You must ask for proof of the prices...they are ridiculous! Ask to see bills and call the company to verify if it seems fishy. Get copies and get a voice recorder just in case the landlord turns on you. Do you have proof of that free shampoo cleaning? (Ask him and record it!) If not than they can charge you for it. Sorry. Usually they use the deposit to cover all that...did they send you a bill saying you owe $1420 or was it a bill for $700 that was to inform you about losing your deposit? Have you told your landlord to keep the deposit? If you plan on suing, good luck and i hope you win...meaning don't owe $1420! |

I hope you have photos of the place when you left it. Your landlord is hoping you'll just fork over. Sounds vindictive. If I were you, I'd sue in small claims court. That would require the landlord to show up in court and justify the outrageous itemized charges. Be prepared. Bring whatever pix you have and get two estimates from Merry Maids or another cleaning service re: an apartment that size. Ask what they charge for dusting a fan. Then submit these documents to the court. I'd also ask for back wages for the time it will cost you to disprove these claims. My guess is the judge will find the charges unconcienable. |

Yes, it would have been cheaper if you had done the cleaning and repairs yourself. Carpet shampooers can also be rented for a reasonable price and carpets are generally cleaned between tenants. Most tenants have never been property owners and don't realize the expense involved in property maintenance and repair. It does seem excessive though, so I wonder if you've understood the charges or if the landlord has lost records of your security deposit, or if you're behind on rent. Talk to the landlord, reasonably, and see what can be worked out. He can take you to court if this isn't resolved. |

I have seen the holes from a flat screen, it took a contractr a long time to fix that.
You can fight this in court but as long as the charges are reasonable (the ones you listed are) they will have no problem.
You needed to leave the place exactly as you found it, and you did not do that. |

I didn't think that landlords could charge whatever they wanted...30 dollars to dust a fan seems outrageous!
Also, was it in your lease that you had to have the carpets shampooed before you left? The land lord just can't charge you for normal fees that they have to pay to rent out the apartment again. As long as you left the apartment in good condition your landlord can't charge you for normal wear and tear. I've lived in many apartments and have never heard of this!!! |

ok, one, yeah, they can charge you whatever the heck they want, and 2, about the carpet cleaning, you should have made sure to verify that they would do it for free, just because you missed yours, doesn't mean they are going to do it for free for you now - for example, it could be that the free cleaning is a reward for renewing your lease, in which case why should they do it for free if you moved out? i'm sorry to say but since you chose not to clean/repair the place yourself, they can charge you what they want. stinks but there you go. also i don't quite agree with your math. moving is expensive, that's a fact. |

They are allowed to charge what ever they want...you are free to dispute the charges in small claims court. While you may think the charges are outrageous..landlords often charge for labor costs. |
