I live in Ohio and we have had nothing but problems with the heat in our apartment building. The broiler is old and the landlord has known it has needed repair for at least three years ( that's how long I have lived here). Today we heard him tell maintence that the heat may have to be cut off for a week or more to make the repairs.
It is the end of December and although it's a little warmer than normal for SW Ohio, it is still cold and there are several children in this building including my baby and an infant across the hall. Additional Details forgot to add that we have been using our own electric heaters and since the building is so old our electric bill is 159.00 for last month ( and that is just electric usage). We also got a notice that we are not allowed to use them any more because of wiring in the building. |

time to call the city about this one... your landlord is a scum bucket.
that's a health code violation along with a city code violation and building violation... a week is too long, especially in the winter.. there are laws. |

I would google the renters laws in your state re: required utilities, and time allotted for maintenance.
My suspicion is that he may be required to supply you space heaters in the interim while its being repaired because of the delay.
Otherwise, you would be forced to supply them yourself, which doesn't seem legal to me. |

If you want the repairs done, then, yes, he will have to have the heat shut off in order to make them. However, a week sounds like a long time if they are having professionals do the installation. |

Ask him to provide enough space heaters to warm the apartment to minimum temperature (it's usually something like 60 degrees at night) so he doesn't violate the law.
He only needs to provide the heat source to minimum legal standards, not to your comfort level. |

The owner can temporarily cut off the heat while making emergency repairs.
He loses credibility if he's doing the work himself. He should be offering you an alernative heating source such as a few electric heaters if the problem is that bad. |

If the system has to be shut down to make repairs, then yes, he will have to do that. The alternative would be to live with the broken heating system through the coldest months of the year, and I'm sure you don't want to do that, either.
The landlord probably *should* offer some kind of reduction in rent for the period of time that the heat is shut down, or perhaps offer to rent space heaters for you -- but I don't know if he is legally obligated to do so or not.
Google "tenants rights +ohio" for some phone numbers of people you can call and ask about this. |

You have the right to heat. . .especially if you have small children. Tell management that no heat is not acceptable and he will have to provide alternate housing or heat. If he doesn't call your housing authority and find out your rights. Here we had to put people up in a motel during some repairs so that they could live in the comfort they expected when they rented the apartment. They also got a bit of a rent reduction for the inconvenience. You have rights and don't have to accept the landlord's problems as your own. You are paying for a decent place to live and so should have it. |

What you heard is a possibility, not an actuality.
I would put your request to have the boiler replaced or repaired once and for all within the next 30 days.
If it means no heat, you should also request a rent discount for the days you will be out of the rental location due to no heat or in exchange to stay in a motel for the days without heat.
Either way, this has been an ongoing problem that the landlord has chosen to neglect. Should have had it repaired or replaced in the warmer months when it wouldn't have been such a big deal! |

I am shocked at the uneducated level of answers to this question.
If a power company cannot legally turn off power if you owe even 10,000 if you have medicine that needs refridgeration or oxygen tanks then use your head people!
A landlord is allowed to TEMPORARILY turn off the heat IF it is NEEDED to make repairs. But then he will be required to also provide space heaters and such. He cannot just say turn the heat off. Would he do that in his house and to his family? NO I dont think so.
If he does not try to give you a space heater or put you in a hotel which the law woudl require, call city hall and tell them. You are LEGALLY allowed to withold rent in cases like these. |
