Can our landlords do this? We are renting an apartment.?
My husband signed a lease about 2 years ago. After 21 months the land lords decided to turn some of the apartments into condo's. So, they told us we had to move out and if we wanted we could move into another apartment if we signed a six month lease on the new apartment. We did. We pay our landlords for the water and the rent together. It has always been a set amount. After our six months was up they raised the rent and the water was not included. I want to know can they raise our rent and expect us to pay the extra amount when we signed the lease. They are threatening to turn off our water, because we assumed there was a mistake when they raised our rent so we haven't paid the extra amount for the last two months. We have been paying the same amount we have been for the last 2 years. Our we in the wrong and should we pay the extra amount or should we say forget it and leave it unpaid. We our moving at the end of the week to a place closer to my husband's work.

If you are under a current lease and that lease agreement states a set amount, the landlord can not change it. After the current lease expires, then the landlord can draw up a new lease with a new amount. And it is illegal for a landlord to shut off any utilities for any reason!

They can raise your rent as soon as your lease is up. They can also change any terms they want to. If you do not pay them what is owed they can trash your credit rating.

Once your six month lease expired, the landlord can raise the rents monthly, if they wish. This includes requiring you to pay for water when you have not previously done so. You should pay what you have not paid. You owe the money.

I hate to say it but if the lease is up they can do that as wrong as it may feel they have the right.

You signed a lease for the raised amount of rent.
Thus, you have to pay that amount.
They cannot turn off your water, I am guessing it is master metered for the whole property or building.
Yes, they can raise you rent, which you agreed to when you signed the lease.
I hope you gave proper move-out notice since you are not complying with your lease rent payments.

Okay a few parts here:

1.) When you signed the new lease (6 month lease) that automatically voids/cancels the old lease (2 year)

2.) At the expiration of the 6 month lease, they landlord is free to change the terms, as the contract has expired. You are free to NOT accept the terms, but in this case would result in you not living where you are anymore.

As far as the extra cash for the water - was there ever a notice of any type ie-verbal or written that the water was no longer included in the rent? It's usually presumable that when a lease expires the terms remain the same unless the parties to the contract amend the terms. On that note (and if you've been given no notice) I wouldn't pay that bill.

If the term of the lease had expired, they can change any of the terms that they want, including rent increases and utilities. They could legally pursue you for the extra money if you do not pay it.

They can raise your rent at any point, but have to notify you in writing so many days ahead of time. If the new agreement doesn't include water then you're stuck paying it yourselves, or you can just leave. If you're on a month to month (your lease has expired) you have the right to leave at any point, but have to put in a 30 day notice before, or you will be liable for the rent for however many days your notice didn't cover. You *can* leave the debt unpaid and walk away, but you may get a letter from a lawyer, or collection agency, in a few weeks, notifying you that you owe x amount on an unpaid water bill. My suggestion would be to speak to your local tenant agency, I'm not sure what it would be called, but all landlords have to answer to the city, so you can check with them to find out what your rights are as a tenant. Try the city/town hall.

You should checkout the laws in your state regarding tenants. From what I have been told, lanlords can't just change rules from what was written in the contract and signed.

I don't know what state are you living in. In California, they cannot ask you to move out of your old apartment just because your landlord wanted to convert it to a condo. They are supposed to pay you relocation fee which should be pretty substantial. If you agree to be relocated, you have to agree that all the conditions are comparable which is really difficult to get. Most landlord usually just pay you off not wanting to confront you with the headaches. Try calling your housing authority in your area. They maybe able to give you more information. Good luck.

If your lease is up they can raise the rent and make you pay for the water bill on your own however if the water bill isn't in your name or it's a well your landlord needs to stipulate who pays it.

Yes, Many Places are turning from Apartments into Condos; This has become very Commonplace...!! After Original Leases are up, they can Raise Rents and change Utility agreements; they are in business and need to pay their Bills too....!!
Alternative is Buying Your Own Place, Where You will need to Pay High Taxes, High Insurance Rates, and Huge Utility Bills...!!
It's a "Double-Edged Sword", We Can't Win Either Way....!!

Of course he can raise the rent, your initial agreement is over and he can enforce a new one. you have to pay your land lord the rent outstanding. if you don't he will sell the debt to a debt collector and they will "black spot" you from now on. its theft!

Laws vary by state (and city.) In most cases, when the lease expires you are month to month. If they give you 30 days notice, they can raise the rent. Charging for water is effectively a rent increase. If they didn't notify you about the change in advance then you can take them to small claims court.

By law, if you have a signed contract stating what the rent is and for how long, plus what is included in the rent. Then No they can not. You can take them to court, but only if it is a signed contract by both parties. Also it most stat what amount you are to pay a month for everything. Please read it carefully. Good luck!
