Robin C | Can someone cash a check that is three years old by changing the date from '05 to '08? ? |
My old landlord was foreclosed on at the beginning of the year. I moved out a few moths later and now am in a new house, new landlord, etc. The old landlord cashed a check (i think the deposit) from 2005 last week. He changed the date, from November 2005, to 2008 by altering the year. Wachovia is pretty much telling me to piss off, their fraud division says it is my problem since the check never had a void date. I flat out for got about it. I have not even spoke to my old landlord since December or so of 2007.
Any help? Ideas on what to do? This over withdrew my account by damn near a grand. I am even having a hard time getting Wachovia to refund the "overdraft fee".

From what I've read and understood in the past, checks that are presented for payment don't expire unless it says so. If you look at most company checks like paychecks, money orders, and rebates, it will have an expiration date on it to prevent this same sort of problem. While changing the date might be frowned on, it's likely to fall under the 'No harm, No foul' doctrine of the law since it doesn't really change anything as far as the amount of money involved.
Edit: The laws on checks are not real clear, beyond insufficient funds. It mostly is a matter of banking industry standards and individual bank policies and this is true with the stale dated argument. Generally, if you present a check for payment, you are obligated by it and banks can honor it in good faith despite the date, memo line writing, or lack of signature. The law recognizes that checks are handled in bulk and it's simply not possible to look at every single one. |

Well that is illegal. Checks, unless they state otherwise, are stale dated after six months.
Altering a check is completely illegal and the check should never have been accepted by a bank. What you need to do is get a copy of the check, see if it's visibly altered. Do you save duplicates to checks you write? You could even use the check number to show that the check is out of sequence.
If your bank won't help you, file a police report. I would also suggest switching banks after you have this resolved. |

Contact the police. That would be fraud.
Checks are stale dated after 6 months. The landlord changed the date because he knew he wouldn't be able to cash it otherwise.
I would also speak with the branch manager of your bank, it that does no good, ask for someone higher up. If after all that they will not respond favorably, switch banks. |

lol, so you're saying that when the money never came out of yur account you just figured you had gotten over and decided not to say anything? "check never had a void date"- does that mean there is no expiration date on the check? If so, why would it matter. Now, why is he cashing a deposit check? Did he not give it back to you or did you damage the apartment and he kept it- basically did you owe him the money? If he altered the check its illegal, but if you owed him the money (and you knew it was never paid) you can't really be mad. |

I've had check problems too and have called customer support several times. Most of the times they are helpful and understanding because they want to keep you as a customer. Sometimes they are a55holes and hang you out to dry. In this case, write to the bank's head office (instead of the customer service). Explain your situation calmly.
At the same time, consult a lawyer. Take advantage of free consultations.

Your bank may say that not having a void date makes the check legal, if that was the case then he would not need to change the date. But just the fact that he did change the date meant he believed the outdated check could not be cashed. However, that said, if he is entitled to that money then the most you can get back is the overdraft fee.

I would call that illegal. You can't just go around altering people's checks. Most banks have a policy that they won't cash old checks. It would seem you could prove when you wrote it, if you keep a ledger of your checks. I'm guessing you were unable to get your deposit back when you moved out? I'm wondering if he is claiming that you left damage for him to repair, which still doesn't give him the right to alter a check. |

Know it may be a crazy question (just because it's been so long) but do you have your carbon copy from the check? That could be used as evidence against the old LL. Find your old bank statements that show the check #s from that book of checks and when you wrote them.

The district attorney should be able to help you, he basically forge your handwriting thats against the law too because why on earth would a bank cash a check that was 3 years old and just assume you have the money in the bank and i dont understand why they would cash the check if you didnt have the money in the account either you would think with todays tecnology being able to go negative in ones account would be a thing of the past |
