Can the HOA make me change my the color of my house?
A couple of years ago the HOA gave me their approval to change the color of my house. They have picked new colors and won't let me do any touch ups. They want me to paint my house a color on the new color list. I love the color it is now which they originally approved a few years ago. I could understand if I wanted to change the color, to pick a color on their new list but can they make me change the color right now. They are presently fining me $100 first month, $200 second month, $300 third month ,etc. ect. with no end in sight (I am up to $500 this month). I can't afford this because I am presently not employed and have some family tragedies with hugh medical bills. Do I have any rights and is this fine legal?

A HOA can do anything they want, this is the reason I refuse to EVER live in one...take for example, the older gentleman in Fl. that let his green grass go brown because he was paying his mortgage instead of the landscaping company, the HOA had him put in jail. HOA are a joke.

sounds ridiculous to me. It all depends on what you signed in the HOA terms and conditions. Read that. It should answer your question. You may also try calling a news station and asking them to run a piece on your situation. Sometimes that can put pressure on people imposing stupid rules. Good luck.

yes, it sucks but it is legal. you have to comply. find a way to paint the house. borrow money if you have to. hoa's can cause you big trouble and even take your house if the fees go unpaid for long. good luck to you.

They can keep fining you until the house is painted. They can put a lien on your house and even take you to court to get their money. As for what you can do? You and other homeowners voted these people into office and now your upset with their job and decision making, my suggestion to you is get involved and become a board member.

Read your condo documents. That is what governs.

I doubt they can make you change from an approved color just because they changed to a new color scheme.

You may want to spend a little money to have an attorney write the Board a letter demanding they back down from the fines.

It isn't right and you should contact an attorney or court to stop it now. The fines can lead to a lien on your property, but the means by which they reach it is unreasonable. Also be wary of any credit hits, they mught resort to collections, my HOA will.

Check your covenants associate with the HOA. If you can't find them, the HOA is required to provide them to you. This change needed to be voted on by the HOA members/board. Ensure that this happened.

They have some power, but not ultimate. That fine is outrageous. You may also be able to "work something out" with the HOA, but I'm assuming you've talked to someone already.

Wow.. what an undue burden.... I assume you have it in writing that your house color was approved back when....

You need to address this legally...Find a lawyer who specializes in HOA disputes....common sense says you have a great case....but ..... and maybe the Lawyer can sue them for his attorney fees in addition to undue burden...and whatever else...

Also, you should get a copy of the bylaws that include the approved (updated lists)....by their treatment of you....all houses NOT painted the new approved colors should be getting monthly fines for non-compliance....

Can they really "UNapprove" a color choice....and how is it they even know that you wanted to do "touch ups"...I mean that's just normal housekeeping....odd

I am a landlord and hate HOA's...!!!! good luck and don't delay...

I don't see how they can encumber your home and you to change the color because they want the HOA to look different. Are they making everyone paint their homes to conform to the new color list?

It sounds like they are making you paint your house a second time within two years of the previous paint job.

If you home was in need of a repainting, then yes, they can make you use the new color list. Check with your state HOA regulators. Remember years ago, the HOAs were not allowed to prohibit dish antennas? They can be defeated.

no way. they are wrong. they approved the colors in the first place. if all you are doing is touching up the colors that were approved, they have no leg to stand on. i just hope you have the original approval. if not, you may have more of a fight.

there are plenty of avenues to go to resolve this, but i would just start with the hoa. go up the ladder until you get someone that can make this go away. don't let it linger either because they can impose a lien on the property that can be hard to get removed.
