Can the landlord come in and show your apartment to someone without you being there ?
Hi there,

I just got a call from my landlord. He said someone is interested in buying the apartment/condo and they will be coming to check it out. I told him sure, I am avaialble after work, and he goes, oh it might be during the day, so I tell him I am not comfortable with people peeking in my apartment when I am not there ! So he tells me that it is legal and he can do it if he gives me permission before 24 hours.

Can he do this ? I do not want him or anyone else look in my apartment when I am not there !! I don't think he has the right to do so, he began telling me I am loosing money on your rent bla bla (he is comparing rent to the mortage payment he is paying), but it s totally irrelevant.

Please people, help. I live in South Carolina btw.

Hi, thanks guys for the quick response. i will go through the lease agreement tonight, although I think nothing like that exists. If its not there, does it mean that he can or can't do it ?

Kristen and jacktree, I know they should have access for servicing ..etc, which I am OK with, but this is neither an emergency nor a pending issue that he needs to check it for !! I just value my independence too much and can't allow them to invade my privacy !

In most states he must give a 24 hour notice when showing the unit for sale. He has the right to show the unit and you have to let him with proper notice. Telephone notice is acceptable in most cases. If there is not a 24 hour notice you can deny access. That's how it goes when you rent.

I just went through this and as soon as the sale closed I was handed an eviction notice. My lease did not have a transfer clause in it (the lease was voided at sale.) Read your lease and ask that this be included in it as an addendum prior to the sale.

When you rent the rules are out there and they don't favor you.

State landlord laws in each state dictate proper notice......You can deny permission as long as you offer an alternative. You cannot reasonably w/hold access, anymore than he can reasonably demand access.

Whatever you do, do it in writing!
google your state and landlord/tenant laws to find out the rules....You are well w/in your right to demand no access while you are not there!!!!!

i used to manage apratments and we could show the apartments as long as we gave the people living in them notice. i think its probably legal for him also. check your lease to see if it says anything about this. if you are uncomfortable, try to get off work while they will be there. they don't go snooping through your stuff, they basically walk through the rooms and leave. i think your belongings will be ok.

Apartment, yes, Condo, no. YOU do not OWN an apartment and they can come in anytime they want to survey, inspect THEIR property.
OWNING a condo is different because you OWN it.

I would find out the landlord/tenant laws. I believe that there is a law stating that before your landlord sells your apartment/condo to someone else, they have to offer you to buy it, and they can't sell it for more than what they offer you, or you offer it. I'm not sure which state that is, but if I were you, do as much research on it. Your landlord is correct. And this is generally in your rental contract, as long as he/she tells you in advance. They also need the ability to enter the apartment for servicing needs, like if there is a leak or something.

I think as long as he gives you 24 hours notice he is able to show the condo as long as he is in there with the potential buyer.

What do the terms of your lease contract say? That's what you need to check.
