Can the landlord keep me from putting a fence up?
I am renting an apartament with a small yard in front and the side of the building. I wanted to put the fence up to keep our baby from running out to the street. The lanlord is telling me I can't do it because it would keep her from being able to access the crawl-space door. Can she do that? I would think that the yard is considered mine, since I am paying rent.

The yard isn't yours and neither is the apartment. The landlord is the owner and you can not make any changes without her written consent.
Use a playpen for the baby.

You have no legal rights to put up a fence without the landlords consent. As you do not own the property. So yes they can deny your request.

reenzz
Of course your landlord can deny your request. It's is her property and you can not alter it in any way without her permission...in writing.

The yard is NOT considered yours...you are only renting it.

chatsplas
YES. It's HER property, you are only renting, and you need her permission to put up fence. She has right to control type of fence, appearance, also, if she gives permission. You have only a right of use, not a right of alteration.
READ your lease, it generally provides you can't do anything like put up a fence without permission in advance from LL. Suggest you work out a compromise with her in placement of fence, etc. And maybe she doesn't want it because she doesn't want baby alone in yard.

I like the part, "I would think that the yard is considered mine, since I am paying the rent." So, are you paying the mortgage, taxes, property insurance, and all other expenses for upkeep and maintenance. Is your name on the deed? No, the property is not "yours" to do what you want with. Buy a house with all of the expenses listed above, then you can put any fence, any size, anywhere up in any part of YOUR yard. Since it is HER yard, you need HER full permission, and she has no obligation to permit you, or pay for it, if it is for your use due to your baby.

You cannot install a fence or any other improvement without the landlord's permission. The yard is not yours; your rent gives you the right to use it, not alter it.

Yes..she can. It's her property.

Yes she can do that. The yard is not yours, it is hers, and you cannot restrict her access to the property in any way.

Libby
You may pay rent but you have no claims whatsoever to put up a fence. Ride out your lease and move somewhere else.

estielmo
You cannot make any "permanent" alterations/chenges without written permission. Talk to a fencing guy about a portable fence of some sort.

Or offer to pay for the whole fence and have it designed in such a way that there is a gateway of some sort that allows access to the crawl space.
