My boyfriend and I were out of town for a month. We gave the rent money to a friend who was staying there to watch our cat while we were gone. She ended up not paying it so we got an eviction notice 2 weeks before we got home. When we got back we stayed at my mothers and placed many phone calls to the landlord to get out belongings (especially my sons who was 2 months at the time). The landlord told a police officer that all we had to do was call her to set up a time and date to get our stuff. She always had an excuse not to. Now about a month ago we talked to a lady who was told by people renting from our old landlord that she gave them some of our belongings and the rest is in storage. What I want to know is can my old landlord do that? |

You ARE liable for the rent, jerky friend or not. It's your rent, so it was your responsibility to pay it. So actually, it was your fault. Sort of. However, you cannot be thrown out without 30 days notice, your refusal to move out, and then an eviction order from the court. |

This most likely was an illegal eviction. It takes up to three months to have someone evicted off the property. Were you served with orders to vacate the premises by the sheriff? Generally the persons belongings are set out on the curb.
You need to contact an attorney in your area and take her to court for a possible illegal eviction and the return or replacement of your items. |

Probably NOT legally.
You have poor choice of friends. Next time pay the LL in advance yourself. Should have returned to your apartment. An eviction notice is NOT final without court action. Should have persevered with police and LL. You have waited too long, been too passive, which makes me wonder if there is more to story. Problem is state laws on abandonment, and you have to prove your efforts to get your stuff which shows you did NOT abandon property. Send LL certified letter, restating position and requesting your property, setting date and time. Then sue him in small claims court if you don't get satisfaction.
Despite other poster, many state laws are skewed in favor of tenant, and law-abiding LL is stuck with nonpaying tenants for months. |

Google landlord tenant laws in your state. If you got the notice why didn't you take action immediately? Most states require a court hearing and that date should have been in the notice you received. After a landlord has been given possession of the property, he is not responsible for your personal property. You're lucky that most of the property is in storage.

Never in my life have I heard a landlord evicting someone within a month's time of failure to pay rent. It usually is a process and takes time. Sounds like an illegal eviction here.
And as for your friend. I hope you dealt with her SEVERELY |

Depends on which state you live in,but you will find that 99.9% of the time the judge (if you decide to go to court) will rule in favor of the landlord.In California you have 24 hours after you vacate to remove your belongings.After 24 hours it is considered abandonment of property. |
