Your question isn't clear if you live there with-out a lease or if you paid a deposit but didn't move in. If you moved in (with out a lease), then yes he can keep your deposit if: you either moved out with-out 30 days notice or moved and left damages exceeding the amount of deposit. But If you haven't moved in because you changed your mind then you can raise hell about not getting your deposit back and soon after, tell him: "okay, I'll take the place". Your money will be refunded immediately. Good luck. |

At the complex I work at, if you apply for an apartment and are approved, you pay the security deposit as insurance on our part for two things: first, if you decide not to take possession of the apartment like you said you would, it is no longer refundable. and of course, secondly, for any damage to the apartment upon move out. we make people sign a reservation receipt that explains the terms of the sec dep. if you didn't sign anything in agreement, you have room for argument. if you did, you're SOL. |

yup, unless someone else moves in when you were going to. They can't double-charge. The deposit is to make sure you do what you said you would do. Talk honestly and don't screw them. Let them know you are sorry and offer to help them get someone else into that place to get your depo back. |

What does the contract say? Sometimes deposit is non-refundable. Contact your state's Attorney General's Office, located in your state's capital. If your deposit being held illegally, they will tell you what to do --- and it's free. You can call information to get the phone number. |

That's debatable, depending on your locality. Generally, it depends on what the lease says. i.e. whether it is a good faith deposit or a security deposit. But, since you have not signed a lease, it's pretty much your word versus the landlord's word as to the legal purpose of the deposit. Some times a landlord will ask for a deposit to hold an apartment until the lease is consummated. That way they don't lose potential renters if you change your mind. Which is what I suspect happened in your case. The landlord will claim that they are withholding the deposit to offset the loss of money while you tied up the property.
You can take the issue to small claims court, but it is doubtful you will recover your money. A lot depends on the length of time between the payment of the deposit and the point at which you announced that you had changed your mind.

In my experience, once an application is approved, the applicant has 72 hours to cancel with no penalties. If they cancel after that deadline, the management is entitled to deduct damages from their deposit. Damages being lost rent in this case. It really depends on the wording of the application and the particular laws in that state. |
