Can the landlord turn off the heat in your apartment?
It is summer but it has been low 50's at night were I live and has gotten very cold. She shut off the heat for the summer, is that legal to do?

Where I live the landlord only has to provide heat between Sept 15 and May 15. This is in Illinois -- maybe it's different where you live?

If you don't have a lease agreement between you and the landlord,
then you don't have the law on your side.That's why your landlord
turns off your heat.Turning off your heat will not be misconstruded
as constructive eviction, because you don't have a lease contract.

Yes, the landlord can turn off the heat during the "off season".

This would be covered either by your state's landlord/tenant laws or local housing codes and ordinances.

My local housing codes, for example ***:

Every dwelling shall have provision made for the installation of heating facilities which are properly installed and are maintained in safe and good working condition, and which are capable of safely and adequately heating all habitable rooms, kitchens or kitchenettes, bathrooms and water closet compartments, ***in every dwelling unit therein to a temperature of at least sixty-five (65) degrees Fahrenheit with an outside temperature of zero (0) degrees Fahrenheit,***with the reading taken at a distance of three (3) feet above floor level.

New Jersey codes, for example***:
If your lease requires the landlord to provide heat, the landlord must give you the amount of heat required by the state codes and the local town or city ordinance. Under the state housing codes, ***from October 1 to May 1***, the landlord must provide enough heat so that the temperature in the apartment is at least 68 degrees from 6 a.m. to 11 p.m. Between the hours of 11 p.m. and 6 a.m., the temperature in the apartment must be at least 65 degrees.

No! It cause's your unit to be considered un-inhabitable. Call your local Housing Authority office and find out if you can put your rent into an account to be held until such time the landlord fixes your problem.

It depends on the agreement you have with your landlord rather than what's right or whether you have a right. If there is no agreement, you may want to consider moving out, renegotiate with your landlord or use a blanket that might keep you warm. There is no point in argueing about the matter even if you have the rights, your landlord can simply get another tenant.

she can't do that if it's cold. get the number to your Human Rights Dept. and let them know what's going on. they should be able to help. good luck and try to stay warm. :)

In my state, an apartment doesn't have to have air conditioning but it has to have heat and that heat has to be under the tenant's control for a legal rental.

In the meantime, I'll give you a suggestion.

They have something called ceramic heaters (they look like a small box) that are about $100. You can pick them up at any home improvement store, they are extremely safe and energy efficient. Just plug it in, put it on your dresser, and shut your bedroom door...it will heat the entire room in about 10 minutes.

I used them alot when I was in college.
