Technically you're supposed to make any final repairs to the place that you caused. Such as hanging pictures or mounting tvs...you're responsible for patching the holes. You're also supposed to try and erase whatever is on the walls as well (if you can't than they can tell you that you should have asked for some paint and you could have repainted those spots). As far as the carpet...a lot of times they replace that anyway...so I don't think they should charge you for that if it's normal wear and tear. Now if an animal used the bathroom all over it that's a different story. |

Yes it's legal. you are responsible for leaving the apartment in the way that you found it. The only things you aren't liable for is what's noted on your damage report which should be complete before you move anything in. |

yep.. it is legal. but did you pay a rental deposit when you moved in? if so.. that should cover most of the damage and you shouldn't have to come up with much if any money |

well generally you put a deposit down when you move in to take care of those types of issues. So the question is have you? At the beginning did they say anything or is there anything is your lease that states you would have to pay. Generally carpeting, repainting of the walls and filling in nail holes are done no matter what anyway so i would have to say no. Go find an attorney and see if they are willing to sit and talk to you and see if this sounds right to them. |

yes! that is why it is important to do a walk through with the manager before and after, so u don't have any disputes, take pictures of the carpet or wall if they were dirty or you'll end up paying for it in the end. you need proof! I watch the peoples court! and put everything in writing with both your signatures! |

Unfortunatly yes. Every time I've moved from an apartment I have filled all holes in the walls and scrubbed it down. I pretty much have always paid for wall paint and new carpet. |

I'm not sure about TX, but in most states they can take it out of your deposit. They have the right to take deduct any amount for damages they think you might have caused. That is why it is so important to do a check of the place before you move in and mark down all the defects. It is also important to leave the place as clean or better than it was when you moved in. The less work they have to do the more of your deposit you will get back. |

Yes, the charges for all three are legal. The carpet is the most iffy one, since ordinary wear-and-tear includes normal soil. But if you've left stains, you'll need to pay for their removal. Likewise, the holes in the wall and the writing on the wall will require repair and repainting, which you should pay for, since they are not normal wear-and-tear. |

Unfortunately yes. We're in DFW but we had same issues got a bill for some ridiculous repairs, usually if carpet is bad they take it out of your deposit. |

You damaged the apartment and no matter what length you were there, you have to pay the damages. You could offer to clean the carpet yourself on hand and knees with Resolve. As for you writing on the walls, you're an adult and we don't do that. My 2 year old knows better. |

Anything that wasn't previously written down on a damage disclosure sheet prior to move in, they can charge you for.
As a renter you have a right to go thru with the Landlord and write down any stains, holes in wall, carpet stains, anything, that way when you move out, you don't pay for other peoples doing.
So yes, it is legal for them to charge this....
Also you have a right to a walk through with your landlord to discuss the condition of the apartment...

You are going to have to look at your lease. If, in the lease it says that you are responsible for the carpets, walls, etc prior to moving out, then you are legally bound to the financial portion.
You can probably go to Lowe's or Home Depot and get a patch kit for probably 5 dollars. There is a blue tube from DAP that works well. |

don't know about tx. but in ca. landlords are required by law to have the carpets steam cleaned. as for the holes, yes...they weren't there when you moved in and you didn't patch them, so the landlord has to pay for someone to fix them and then that cost gets deducted from your deposit, same with the writing on the wall. these are not normal wear and tear repairs so you will be charged for them. btw in ca. if you rent the same place for more than 3 years then you won't be charged for paint and carpet cleaning |
