I never signed any papers to move in, the verbal agreement was that I would pay $700 a month and it would be month to month, no utilities just $700 for the room. Well after 3 months of being there I decided it wasn't working out so I told him I found my own place and this would be my last month. And last night (1 week before I'm leaving) He came and confronted me with the gas and electric bill saying that it was very high and he wanted me to pay for it. He said I leave my heater on even when I'm not there. And I asked him how he knew that since the heater is in my room. He said because he has been in there when I'm gone and the heater was turned on and also said he looked around and the place was not being kept up. The room is a converted garage with no insulation, so sometimes I do leave it on when its super cold and thats because I'm 6months pregnant and I have a 3 year old baby and the room takes forever to get warm.
So my question is - 1) am I wrong for saying I'm not paying that and 2)Was he legally allowed to go into my room like that |

It's too bad for him he did not include utilities. He cannot make you pay for them now even if they are excessive. He would have to give 30 days notice for any change in the lease terms like paying utilities. And since you are leaving then he does not have time to do that. Also you are technically required to give 30 days notice when leaving. He may have a right to another month of rent. No he is not allowed to enter the Premises which you are renting, but again you are leaving, and cannot do anything about it at this point. |

1. Your name is not on the utilities, correct? In that case, you can just tell him to buzz off.
#2. Inform your landlord that renting out a garage is *ILLEGAL* and that should he decide to pursue you in court for the utilities, then you will go to the local housing authorities in regards to him renting you the garage. Make sure you have copies of all checks (you didn't pay cash, right?) and pictures of you being in the garage with your stuff. You'll need actual proof you were living in there.
#3. Is he legally allowed to go into your room? Depends on your state and if a verbal contract is an actual contract. If verbal contracts in your state are enough to be an official contract, then no, he cannot go in your room without 24 hours notice (in most cases) and he has to have PROOF that he gave you 24 hours notice (i.e. certified letter or other means).
I have to say tho'... if you're pregnant and have a 3 year old, I'm not sure why you would want to live in a garage that is not insulated... doesn't sound very safe for a pregnant mom to me. Where's the father in all this?

You don't have a lease since this is a verbal agreement. Also, this is probably an illegal rental situation to begin with. Your name isn't on the utility bills, so it will be your word against his. Cut your losses, and move out now. |

Both of you are wrong-#1 he can not rent out a garage that is against the law. If the County Health Department knew that he would be in serious trouble.
#2 You were probably desperate and that is why you agreed to pay $700 to rent a garage?? Pack up your stuff and get out of there as soon as you can. Apologize for leaving the heater on, and until you leave buy some blankets to put on your bed. I hope that you are not sleeping on the cement! |

Is is bad manners for him to enter your room and an invasion of your privacy. [not illegal]
If you had a lease agreement it would be illegal without 24 hours written notice except in an emergency.
You should of explained to him about the time to heat the room, lack of insulation and the baby etc...
However you should be honest and pay what you owe. |

If you have not signed any papers then the answer is yes the owner can enter any room of their choosing at anytime. I think that you are wrong for not paying your part of the obvious increase in the utility bills but legally you have no agreement to pay the utilities. I think you should ask this question to a lawyer so that you know wher you stand below is a link to a forum that will allow you to get an answer to that question from a legal professional.

If you had a contract it should say it on it, if it does not say anything about it, that would be trespassing. If you don't have a contract, you are basically a guest in his house, and,yes! he can get in your room.
You are not obliged to pay for the utilities, because there is no contract that says so.
Advice: Always put everything in black and white. |
