Can the real estate person really do this and get away with it? Should we pay him?
We signed a 90 day contract with a real estate agent to sell our home. During that 90 day period he was supposed to advertise three times in the local real estate magazine -- well he goofed and advertised four times. He called us and said that he would not be charging us the $600 for the last advertising because it was his error. I also have an email to that regard.

At the end of 90 days he had not sold our home, so we went with another agent and the home sold within two weeks.

We got the bill for the advertising from the first agent and it was for 4 advertisements. I called and he told me, well I should have had the sale, so that is money I am out and you will have to pay for it, because you switched agents and lost me a commission.
Additional Details
After the 90 days was up there was no contract. The contract said that we would agree to pay for the advertising costs that we approved. We did not approve that advertising we only approved for three ads.

He should not be charging you for any advertising, that should be on him, one of the costs of selling a home. I have sold a dozen of mine and never paid a dime over the agreed commission.

I would complain to his broker. He really should not be in this business.

If the story is correct, then NO you owe him nothing. If fact, had he tried to get the 4th ad, you would have owed him nothing.

UNLESS it was written in the contract. But this is the first time I heard about this type of thing.

These expenses are part of the business for the agent.

The answer is in your contract with him. There may be something to the effect that if the home doesn't sell under his contract, but it sells within a certain amount of time, he still will be reimbursed for his costs. If so, you are on the hook. If not, take it up with his broker (boss) or local Real Estate Board.

It would totally depend on the listing agreement you had signed with him and the terms that are agreed upon. It would be easy to say no because this would not be typical and he even sent you an email about his mistake, but you my need to show all documentation to an attorney if you are confused after reading your listing agreement. Good Luck

Ignore him. it sounds like you are in the clear, he can try
to take you to small claims court, but I think you would win.

You documented that he said he wouldn't charge you.

You didn't violate any contract stipulations.

You shouldn't have to pay anything since he didn't sell the house.

I had a similar situation in when I sold my house in Fl. earlier this year. He was charging me for advertisement he put in a magazine after the house had sold. I contacted an attorney and was told to tell the real estate agent to stick it. I sent the letter to the agent and haven't heard from him since.

Wow.. not professional. Call his broker and tell them what transpired. If that doesnt help call the local board of realtors and report him. Realtors are held to very strict legal and ethical standards... assuming that this guy is actually a member of the National Association of Realtors.

No he can't, he had a fair chance at selling during the 90 day period. He did not, contract up, so boot him, and the next guy had a fair chance. Did the job right. You don't owe for 4 ads, he goofed not you.

Don't feel for this guy, report him to the board of realators from that area if he keeps on.

This agent sounds similar to one I recently ran into. Being out of state, I called a national real estate agency to ask for a recommendation for an independent appraiser for property I just inherited. This agent insisted he could pull comps and get me an appraisal that would be very accurate. He pulled comps, but compared a house on a 50,000 sq. ft. lot with ones that were on 7,000 sq. ft. lots. I told him I had done some research on line and thought it was best to get an appraiser. He took it upon himself to find other comps and then went onto the property, even though I had told him I did not want him to do so because the co-owner of the property, who lives nearby, would be infuriated. Not only did he go onto the property without telling me he was going to do so, but he also went up to the door of the co-owner. She was infuriated, as I had indicated she would be. He then sent me an email, telling me I was being "milked" for expenses by a co-owner who was refusing to sell. Then he told me he "trusted me" to send him a check for all his help. (Every time he had called me, I told him I had made many calls, even to an attorney, to get questions answered. I never asked him to do any work or be my agent.) Interestingly enough, he asked me to send the check to one of the two houses he has listed on the company's website - not to his real estate office. (I guess he owns this property.) This agent harassed me over the phone, requesting six times that I find him the number on my title, despite the fact that I told him I was to ill to climb the stairs to get the number. I had to say, "Good-bye" and hang up. As his emails indicate, he cannot write a cohesive sentence. Would his broker be concerned about his qualifications and his asking for money to be sent to his home?
