LadyCatherine | Can they kick my out for this..? |
I have gone over my lease several time and find nothing on it about this..
For the next few months I am going to be late with my rent. Two weeks each month late. There is a late fee of $15 that I plan on paying with my late rent..
I was wondering if I am alway late with the rent can they kick my out.? |

As a property manager, the answer is no. they cannot kick you out, as a matter of fact, some investors does like to have the extra fee added to their ROI's, the more the merrier.
So seat back and relax, if you are planning to make the lease/rent payments within the contractual time allowed for late fees and not going beyond that, they will love you for it and you will become their first and foremost favorite tenant.
Have you ever found someone or some company that does not like to get extra money for doing absolutely nothing except waiting a few extra days? This is how banks, mortgage companies, phone companies and thousands of other companies make their living, just by adding a late fee to their contract.
I rest my case and you go asleep. |

They probably wont if you tell your landlord ahead of time along with your reasons but tell them now. |

i dont think they would kick you out so long as you still paying the rent in addition to the late fee....but i assume if that keeps up for an extended period of time they may ask you for another deposit...you may or may not have paid one when you moved in...they might be able to kick you out but i doubt it |

Just make sure that they know that you're going to be late, but that you're more than willing to pay the late fee and that you are in fact going to be paying the rent... just a little later than usual.
I'm sure if there is a good reason, and they're not buttheads about it, they'll be ok w/ it. |

Hell no they can't. I want to know where you have a late fee of $15. Mine was $75. It ensured that I was never late. |

Yes and no. No, they cannot evict over one late payment. However, you are in violation of your agreement to pay on time. Conceiveably, the landlord could warn you of your failure to comply with the lease's terms and terminate the agreement based on your non-compliance (i.e. repeated late payments).
Also, two weeks is probably sufficient time for your landlord to file an eviction with small claims so you'll need to pay the landlord's filing fees too ($75-200).
Landlords often rely on rent payments to pay their mortgage and other expenses on time. You may want to offer partial payments and explain your situation. Also, instead of using your landlord as an expensive credit line, try finding some other way to finance your short-term monthly deficit (i.e. payday loan, credit cards, even some communities banks offer small loans). |

Yes your landlord can serve you with a 3 day pay or quit notice. once the 3 days is up and you haven't paid your rent the landlord can legally start the eviction process. I would suggest making a simple phone call to your landlord explain your situation and due to a financial hardship your going to be a couple of weeks late paying the rent for a few months. Also let them know you will be including the $15 late fee.
Don't just not pay rent without talking to your landlord that could really upset them and remember most landlords still have mortgage payments to make and count on your money. |

i say yes because usually it is a warning saying you where late .its like baseball 3 strikes your out but if you stay on the feild they kick you out of the game. |
