Can we be evicted due to a medical condition creating late monthly rent to the landlord?
my boyfriend was diagnosed with cancer and is under medical care. the landlord entered a verbal agreement that we could pay our rent in 2 monthly payments. this is due to his lack of work during treatments. now the landlord is tired of our arrangements and jujst wasnts to evict us. is this legal?

You are not paying the rent. He is under no obligation to house you on his dime.

He can evict you for non-payment and any verbal agreement you have is not binding.

While we can have sympathy for you and your boyfriend, the landlord has bills to pay as well. You have a legal contract to pay money in order to occupy his property, the landlord has a legal right to enforce the written terms of the lease. He is not obligated to accept rent in payments different than the terms of your written lease.

Yes, it is legal, unless you have a written agreement covering that arrangement. I have sympathy for your boyfriend with his illness, but said illness isn't the landlord's fault or concern.

You have to remember the landlord still has to make the Mtg payment and if your not paying rent on time then it comes out of his pocket. Do not make your problems his problems. Its not his job to take care of you. Sorry but that's life.

When you signed the lease, you agreed to pay... he's not going to let you live there for free no matter what your circumstances when someone can come in and pay.

Another illustration of why you should have at least 6 months of expenses saved at all times for a rainy day or two.

Your landlord ratified the agreement by accepting your split payments. However, he can also choose to terminate your tenancy with proper notice. So this is not very understanding on his part, but it appears to be within his right.

I think if the landlord has already accepted 2 monthly payments that proves there is an agreement. But if your a tenant at will meaning month to month he has the right to evict you at anytime with proper notice. If he hasn't sent you eviction papers, a way to delay the eviction would be to find a reason (or make one) to call the Board of Health. Could be something as silly as a smoke detector with no battery. I know in Mass if a complaint is made to the BOH the landlord can not try to evict you for 6 months. Not the most ethical way but it is a way around the eviction.
