Can we be kicked out of our apartment for yelling?
We have had a couple of yelling fights. They only last about 5-10 minutes but now our manager is telling us that she will give us a 30-day notice if it happens again or my husband has to leave.

Yup, you can be tossed out. You and your husband need to learn that your verbal disagreements need to be kept at a lower volume.

Simply put, grow up. Your neighbors are not expected to put u; with your juvenile outbursts.

it's called disturbing the peace. and it is against the law.

Micki
What does it say in your lease regarding noise?

That's a bit extreme but if it's a smaller place, the landloard can have more power over you.

TheMom
Why would you yell at all? The manager should be calling the cops and reporting domestic violence. This is not normal behaviour, you are likely scaring everyone, crazy, screaming people are generally not a great thing to have in an apartment complex.

my2sense
yep! like someone stated it's against the law. Disturbing the peace

If you are in a large complex or owner owns several properties you may be able to get away with more but...if it's just one rental property they can pretty much do as please. Hey they don't want that BS in something they own. If your yelling how do they know it won't escalate? Maybe break/ruin property?

Marysue
Probably so. Most leases have provisions about noise, and unfortunately aren’t well insulated – meaning that you do have to be cautious of your noise levels.

Most couples have fights from time-to-time, but think about if the shoe were on the other foot. If one of your neighbors was making noise that bothered you, wouldn’t you want your landlord to be responsive if you complained?

maeko
Technically, yes. You have violated the "quiet enjoyment" clause of your lease. If evicted ask to talk it out with the judge and explain your situation.

Yelling fights are never a good thing....hope you work it out.

fresh_horses_7
Yes you could be kicked out. Especially if the neighbors complain. You can't disrupt everyone next door to you and expect to get to stay

Who wants to hear your bullchit.

daeve930
Yes you can. I don't think he can tell your husband to leave. That seems a bit presumptuous on her part. But she can evict you all with due process.
