Go to the local district court and purchase a 30 day eviction notice (they cost a buck). Rent doesn't matter, the house is yours. Legally you could evict both.
My best friend just went through a similar situation.
Contract or not it doesn't matter, apartment complexes evict people all the time for noise or whatever. Don't worry about squatter rights. Fees aren't $100-150 unless you hire a layer or something, just go get the paperwork there's only one page to fill out and an idiot can file it.
It doesn't matter if you live there or who pays the bills, it only matters who's name is on the deed. |

2. Some states recognize common law marriage only if they are representing themselves as being a married couple.
3. He can legally stay there as long as he pays rent until an eviction notice is served to him after the hearing. |

I dont know if PA is a common law state, but its your house, he is not family, you can kick his a** out anytime you want.. if you need help with getting him out you can contact law enforcement in your area and they would be glad to help you out |

Common law has nothing to do with it, you are the landlord and if somone refuses the rent, then you can evict them. If there is no contract, and it is a month to month retal agreement, then, you can give the tenent 30 days notice to get out., or petition the court to kick them out. |

Yes Pennsylvania is a state of common law marriage, but only if the 2 parties agree to it. You need to go to the court house and get a regular eviction notice just like any landlord would and he will get 30 days to move out, because he has been paying rent. |

If he didn't go after you asked him then I would draft up an eviction notice even though it isn't necessary, and send him packing. If he still refuses to go call the police. The house belongs to you so you have the control. Best of luck. |

Yes, he can be evicted. Serve notice and have the cops come and kick him out and while you are at it get a restraining order forbidding him to come within a mile of the place. All you will need to do is explain to the judge why you want it and you will get it. Make it good for at least three years. |

if the house is in your name and you dont want him there he has no right and by law he can be told to leave, call the cops and they will ask you whos house it is and they will tell him take his stuff and pick up the rest on another date. |

ok go to the courthouse tell them you want to fill out an eviction notice then have him served with it then about 3-5 days later there will e a hearing and he will have 30 days from then to move out sorry but legally thats the only way filing the notice will cost you around $100 to $150 |

i would consult with a landlord tenant attorney, it may cost 1500 bucks or more, I would kick therm both out, make it easier. |

If they aren't married and you own the house, not your mother, you can legally tell him he has to leave, that you no longer want him living there, the fact that he has been paying rent has nothing to do with it. You have to give him "notice" but he has to leave since you are the owner of the house. |

I think you can if you give him 30 days n if he doesnt leave then change the locks n arrange for him to get his things. Dont put it outside cause if something happens to it then he can take you to court. You need to give them a 30 day eviction notice.Then he has no choice he has to leave and if he wont get the authorities involved.If his address is not at your house legally he shouldnt be there and he can be removed by police now. |

You have to go thorough what ever landlord/tenant laws your state has regardless of the "relationship". Eviction process varies state to state...but it won't be fast. The common law marriage question is a separate issue. |

Yes, but you have to go through the legal process and through the courts. You cannot just go up to him tomorrow and say you have to leave now. That's the laws. You have to give him a 30 days notice and then you have to go to court if he doesn't move. And since you don't have a signed lease, it would be considered a month to month lease and you can evict him for any reason. |

If you own the house & he is not on title & does not have a rental agreement with you (and you are the legal owner) you can call your local sheriff or Police & they will help you
Or call a RE lawyer & see what they say. Or call your local rental board for your city. |

It cost like $600+ to evict someone!!!! and then it still takes like 6 months to get them out... My boyfriend flips homes and with the market being so bad he has rented a few of them out and with evicting someone you have to pay any attorney, pay the cops to serve him, then you have to wait the whole time it goes to court.... its a hard place your at... I'm sorry |

Since you are the legal owner of the house you can tell him that he has to leave. I don't know if they have a common law marriage. I don't think so though. You might want to ask a lawyer that. |

if his name doesn't appear on a lease/rental agreement then since you own the house you can just have him arrested for trespassing regardless of his relationship, personal or otherwise, with your mother. |

I am not a lawyer, but I would say that since the house is yours, you can tell him to leave. Common law or not, he has no legal right to your house. If he does not leave with a written demand I would just call the police and tell them that he is trespassing. |
